55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to courses offered jointly by public junior colleges and
88 independent school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 130.008, Education Code, is amended by
1111 amending Subsection (g-1) and adding Subsections (g-2) and (g-3) to
1212 read as follows:
1313 (g-1) A public junior college with a service area located
1414 wholly or partly in a county with a population of more than three
1515 million shall enter into an agreement with each school district
1616 located wholly or partly in a county with a population of more than
1717 three million to offer one or more courses as provided by this
1818 section. [A student enrolled in a school district to which this
1919 subsection applies may enroll in a course at any junior college that
2020 has entered into an agreement with the district to offer the course
2121 under this subsection.]
2222 (g-2) A public junior college may enter into an agreement
2323 with any school district located in a county in which the service
2424 area of the junior college is wholly or partly located or in a
2525 county adjacent to a county in which the service area of the junior
2626 college is wholly or partly located to offer one or more courses as
2727 provided by this section.
2828 (g-3) A high school student enrolled in a school district
2929 may enroll in a course at any public junior college that has entered
3030 into an agreement with the district to offer the course under this
3131 section.
3232 SECTION 2. This Act applies beginning with the 2021 fall
3333 semester.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2021.
