46 AN ACT
57 relating to eliminating certain reporting and posting requirements
68 for public institutions of higher education and other state
79 agencies and the requirement for a plan by certain school districts
810 to increase enrollment in public institutions of higher education.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 51.402(b), Education Code, is amended to
1113 read as follows:
1214 (b) The governing board of each institution of higher
1315 education in the state shall adopt rules and regulations concerning
1416 faculty academic workloads. In adopting rules under this
1517 subsection, each institution shall recognize that classroom
1618 teaching, basic and applied research, and professional development
1719 are important elements of faculty academic workloads by giving
1820 appropriate weight to each activity when determining the standards
1921 for faculty academic workload. An institution may give the same or
2022 different weight to each activity and to other activities
2123 recognized by the institution as important elements of faculty
2224 academic workloads. [The established rules and regulations of each
2325 institution shall be included in the operating budgets of each
2426 institution.]
2527 SECTION 2. Subchapter B, Chapter 61, Education Code, is
2628 amended by adding Section 61.0341 to read as follows:
2729 Sec. 61.0341. LIMITATION ON DATA COLLECTION AND REPORTING
2830 REQUIREMENTS. (a) The legislature finds that data collection and
2931 reporting requirements for institutions of higher education must be
3032 limited and reduced to the extent feasible.
3133 (b) If the commissioner of higher education determines that
3234 the board has access to an alternative means of collecting data or
3335 receiving information to be included in a report sufficient to
3436 fulfill a requirement under this code, the board by rule may
3537 eliminate the reporting requirement for that data or information.
3638 SECTION 3. Section 659.0201(b), Government Code, is amended
3739 to read as follows:
3840 (b) A state agency that accepts a gift, grant, donation, or
3941 other consideration from a person that the person designates to be
4042 used as a salary supplement for an employee of the agency shall post
4143 on the agency's Internet website[, in addition to the information
4244 required by Section 659.026,] the amount of each gift, grant,
4345 donation, or other consideration provided by the person that is
4446 designated to be used as a salary supplement for an employee of the
4547 agency. The agency may not post the name of the person.
4648 SECTION 4. The following provisions are repealed:
4749 (1) Sections 29.904 and 51.4031, Education Code; and
4850 (2) Section 659.026, Government Code.
4951 SECTION 5. This Act takes effect September 1, 2021.
