7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 1.34, Chapter 626, Acts of the 73rd | |
9 | 9 | Legislature, Regular Session, 1993, is amended by amending | |
10 | 10 | Subsection (a) and adding Subsections (a-1) and (a-2) to read as | |
11 | 11 | follows: | |
12 | 12 | (a) In this section, "retail public utility" has the meaning | |
13 | 13 | assigned by Chapter 13, Water Code. | |
14 | 14 | (a-1) Except as provided by this section, water [Water] | |
15 | 15 | withdrawn from the aquifer must be used within the boundaries of the | |
16 | 16 | authority. | |
17 | 17 | (a-2) A retail public utility that is an initial regular | |
18 | 18 | permit holder and the service area of which is contained wholly or | |
19 | 19 | partly inside the boundaries of the authority may use water | |
20 | 20 | withdrawn from the aquifer to provide water service to customers in | |
21 | 21 | Atascosa County within the retail public utility's certificated | |
22 | 22 | service area. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
