55 relating to the use of water withdrawn from the Edwards Aquifer by

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1.34, Chapter 626, Acts of the 73rd
99 Legislature, Regular Session, 1993, is amended by amending
1010 Subsection (a) and adding Subsections (a-1) and (a-2) to read as
1111 follows:
1212 (a) In this section, "retail public utility" has the meaning
1313 assigned by Chapter 13, Water Code.
1414 (a-1) Except as provided by this section, water [Water]
1515 withdrawn from the aquifer must be used within the boundaries of the
1616 authority.
1717 (a-2) A retail public utility that is an initial regular
1818 permit holder and the service area of which is contained wholly or
1919 partly inside the boundaries of the authority may use water
2020 withdrawn from the aquifer to provide water service to customers in
2121 Atascosa County within the retail public utility's certificated
2222 service area.
2323 SECTION 2. This Act takes effect September 1, 2021.
