66 AN ACT
77 relating to continuing education requirements for physicians and
88 nurses regarding human trafficking.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 156.060, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 156.060. CONTINUING EDUCATION REGARDING THE
1313 IDENTIFICATION AND ASSISTANCE OF TRAFFICKED PERSONS [IN HUMAN
1414 TRAFFICKING PREVENTION]. (a) This section applies only to a
1515 physician who designates a direct patient care practice on an
1616 application for renewal of a registration permit.
1717 (b) A physician licensed under this subtitle who submits an
1818 application for renewal of a registration permit [and who
1919 designates a direct patient care practice] must complete at least
2020 one hour of continuing medical education approved by the board
2121 regarding the identification and assistance of trafficked persons
2222 [, as part of the hours of continuing medical education required for
2323 compliance with Section 156.051(a)(2), a human trafficking
2424 prevention course approved by the executive commissioner of the
2525 Health and Human Services Commission under Section 116.002].
2626 (c) [(b)] The hours [board shall designate the human
2727 trafficking prevention course] required by Subsection (b):
2828 (1) shall be designated by the board [(a)] as [a]
2929 medical ethics or professional responsibility education; and
3030 (2) may be counted toward the hours of [course for
3131 purposes of complying with] continuing medical education required
3232 by Section 156.051(a)(2).
3333 (d) The board shall:
3434 (1) approve courses that may be completed to satisfy
3535 the requirement of Subsection (b), including at least one course
3636 that is available without charge; and
3737 (2) maintain a list of approved courses on the board's
3838 Internet website.
3939 (e) In approving courses as required by Subsection (d)(1),
4040 the board shall consider for approval training courses conducted by
4141 health care facilities.
4242 (f) [(c)] The board shall adopt rules to implement this
4343 section, including a rule establishing a procedure to send a timely
4444 reminder to a physician of the continuing medical education
4545 requirement under this section.
4646 (g) A physician may satisfy the requirement of Subsection
4747 (b) by completing at least one hour of a training course approved by
4848 the executive commissioner of the Health and Human Services
4949 Commission under Section 116.002. This subsection expires
5050 September 1, 2023.
5151 SECTION 2. Section 301.308, Occupations Code, is amended to
5252 read as follows:
5353 Sec. 301.308. CONTINUING EDUCATION REGARDING THE
5454 IDENTIFICATION AND ASSISTANCE OF TRAFFICKED PERSONS [IN HUMAN
5555 TRAFFICKING PREVENTION]. (a) As part of a continuing competency
5656 program under Section 301.303, a license holder who provides direct
5757 patient care shall complete in each renewal period at least one hour
5858 of continuing education approved by the board regarding the
5959 identification and assistance of trafficked persons [a human
6060 trafficking prevention course approved by the executive
6161 commissioner of the Health and Human Services Commission under
6262 Section 116.002].
6363 (b) The board shall:
6464 (1) approve courses that may be completed to satisfy
6565 the requirement of Subsection (a), including at least one course
6666 that is available without charge; and
6767 (2) maintain a list of approved courses on the board's
6868 Internet website.
6969 (c) In approving courses as required by Subsection (b)(1),
7070 the board shall consider for approval training courses conducted by
7171 health care facilities.
7272 (c-1) A license holder may satisfy the requirement of
7373 Subsection (a) by completing at least one hour of a training course
7474 approved by the executive commissioner of the Health and Human
7575 Services Commission under Section 116.002. This subsection expires
7676 September 1, 2023.
7777 (d) The board shall adopt rules to implement this section,
7878 including a rule establishing a procedure to send a timely reminder
7979 to a license holder of the continuing education requirement under
8080 this section.
8181 SECTION 3. Sections 156.060 and 301.308, Occupations Code,
8282 as amended by this Act, apply only to an application for renewal of
8383 a registration permit to practice medicine or a license to practice
8484 nursing submitted on or after the effective date of this Act. A
8585 renewal application submitted before the effective date of this Act
8686 is governed by the law in effect on the date the application was
8787 submitted, and the former law is continued in effect for that
8888 purpose.
8989 SECTION 4. This Act takes effect September 1, 2021.
