55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain group health care benefits and the promotion of
88 telehealth services for certain persons who are eligible for
99 Medicaid or the child health plan program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 62, Health and Safety
1212 Code, is amended by adding Section 62.061 to read as follows:
1313 Sec. 62.061. HEALTH SERVICES INITIATIVE TO PROMOTE
1414 TELEHEALTH SERVICES. (a) In this section, "telehealth service"
1515 has the meaning assigned by Section 111.001, Occupations Code.
1616 (b) The commission shall develop and implement a health
1717 services initiative designed to leverage federal money available
1818 under the child health plan program under 42 U.S.C. Section
1919 1397ee(a)(1)(D)(ii) to fund technology or infrastructure needed to
2020 promote the availability and use of telehealth services for
2121 providing health care benefits in a group setting to a child:
2222 (1) who is 18 years of age or younger; and
2323 (2) whose annual household income is equal to or less
2424 than 200 percent of the federal poverty level.
2525 (c) To the extent possible, the health services initiative
2626 must be designed to identify children who are eligible for the child
2727 health plan program and children who are eligible for the medical
2828 assistance program under Chapter 32, Human Resources Code. The
2929 commission may automatically enroll an identified child in the
3030 child health plan program or the medical assistance program, as
3131 applicable.
3232 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
3333 is amended by adding Section 32.0248 to read as follows:
3434 Sec. 32.0248. MEDICAL ASSISTANCE FOR CERTAIN GROUP HEALTH
3535 CARE BENEFITS; ENHANCED REIMBURSEMENT. (a) The commission shall
3636 provide medical assistance at an enhanced reimbursement rate for:
3737 (1) prenatal care benefits provided to a recipient who
3838 is pregnant in a group setting with other pregnant women; and
3939 (2) health care benefits provided to a recipient who
4040 is younger than two years of age in a group setting with other
4141 children of the same age group.
4242 (b) In providing medical assistance under Subsection
4343 (a)(1), the commission shall ensure prenatal care benefits provided
4444 by the following provider types are reimbursable:
4545 (1) a federally qualified health center as defined by
4646 42 U.S.C. Section 1396d(l)(2)(B);
4747 (2) a rural health clinic as defined by 42 U.S.C.
4848 Section 1396d(l)(1); and
4949 (3) other facility-based providers.
5050 SECTION 3. If before implementing any provision of this Act
5151 a state agency determines that a waiver or authorization from a
5252 federal agency is necessary for implementation of that provision,
5353 the agency affected by the provision shall request the waiver or
5454 authorization and may delay implementing that provision until the
5555 waiver or authorization is granted.
5656 SECTION 4. This Act takes effect September 1, 2021.
