46 AN ACT
57 relating to certain local government corporations created for the
68 development, construction, operation, management, or financing of
79 transportation projects.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter D, Chapter 431, Transportation Code,
1012 is amended by adding Section 431.1015 to read as follows:
1113 Sec. 431.1015. CORPORATIONS OF CERTAIN COUNTIES FOR TOLL
1214 PROJECTS. (a) Notwithstanding Chapter 284 or any other law, a
1315 county with a population of more than four million may not create a
1416 local government corporation under this chapter to develop,
1517 construct, operate, manage, or finance a toll project or system
1618 located in the county.
1719 (b) An existing local government corporation created by a
1820 county described by Subsection (a) for the purposes described by
1921 that subsection:
2022 (1) may not:
2123 (A) undertake any new bonds, notes, or other
2224 obligations or extend the terms of any existing bonds, notes, or
2325 other obligations; or
2426 (B) enter into any new contracts or extend the
2527 terms of any existing contracts; and
2628 (2) must be dissolved when all bonds, notes, and other
2729 obligations and contracts of the corporation have been satisfied.
2830 (c) This subsection and Subsection (b) expire on the date
2931 that the local government corporation described by Subsection (b)
3032 is dissolved.
3133 (d) Notwithstanding any other provision of this chapter,
3234 income earned and revenues received by or from a local government
3335 corporation created to develop, construct, operate, manage, or
3436 finance a toll project or system under Chapter 284 may be used only
3537 to pay the costs of a turnpike project, as defined by Section
3638 370.003, or a road, street, or highway project as provided for under
3739 Section 284.0031.
3840 SECTION 2. This Act takes effect immediately if it receives
3941 a vote of two-thirds of all the members elected to each house, as
4042 provided by Section 39, Article III, Texas Constitution. If this
4143 Act does not receive the vote necessary for immediate effect, this
4244 Act takes effect September 1, 2021.
