8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter E, Chapter 31, Election Code, is | |
10 | 10 | amended by adding Section 31.126 to read as follows: | |
11 | 11 | Sec. 31.126. MORATORIUM ON CERTAIN ACTIONS BEFORE ELECTION | |
12 | 12 | DAY. (a) Notwithstanding any other law, any changes made by an | |
13 | 13 | election authority to a practice or procedure related to election | |
14 | 14 | administration or voter registration must be finalized not later | |
15 | 15 | than the 45th day before election day. | |
16 | 16 | (b) Notwithstanding any other law, during the 45 days | |
17 | 17 | preceding election day: | |
18 | 18 | (1) Deviations from the practices or procedures are | |
19 | 19 | presumptively invalid and subject to injunctive relief under | |
20 | 20 | Section 273.081, unless there is a declared state of disaster or | |
21 | 21 | emergency under Chapter 418 or Chapter 433 of the Government Code. | |
22 | 22 | (c) The attorney general may obtain injunctive relief to | |
23 | 23 | enforce this section. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2021. |
