| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Subchapter A, Chapter 232, Local Government | |
| 9 | 9 | Code, is amended by adding Section 232.0071 to read as follows: | |
| 10 | 10 | Sec. 232.0071. RECREATIONAL VEHICLE RENTAL COMMUNITIES. | |
| 11 | 11 | (a) In this section: | |
| 12 | 12 | (1) "Recreational vehicle" has the meaning assigned by | |
| 13 | 13 | Section 522.004, Transportation Code. The term includes a park | |
| 14 | 14 | model recreational vehicle. | |
| 15 | 15 | (2) "Recreational vehicle rental community" means a | |
| 16 | 16 | plot or tract of land that is separated into two or more spaces or | |
| 17 | 17 | lots that are rented, leased, or offered for rent or lease for a | |
| 18 | 18 | term of less than 60 months without a purchase option to | |
| 19 | 19 | recreational vehicles for use and occupancy as temporary | |
| 20 | 20 | residences. | |
| 21 | 21 | (b) A recreational vehicle rental community is not a | |
| 22 | 22 | subdivision of land for the purposes of this chapter. | |
| 23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2021. |
