55 AN ACT
66 relating to the rules of the road regarding red signals at certain
77 traffic-controls signals.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1.
1010 Section 544.007, Transportation Code, is amended by amending
1111 Subsection (d) and adding Subsection (d-1) to read as follows:
1212 (d) An operator of a vehicle facing only a steady red signal
1313 shall stop at a clearly marked stop line. In the absence of a stop
1414 line, the operator shall stop before entering the crosswalk on the
1515 near side of the intersection. Except as provided by Subsection
1616 (d-1), a [A] vehicle that is not turning shall remain standing until
1717 an indication to proceed is shown. After stopping, standing until
1818 the intersection may be entered safely, and yielding right-of-way
1919 to pedestrians lawfully in an adjacent crosswalk and other traffic
2020 lawfully using the intersection, the operator may:
2121 (1) turn right; or
2222 (2) turn left, if the intersecting streets are both
2323 one-way streets and a left turn is permissible.
2424 (d-1) An operator of a motorcycle or bicycle facing only a
2525 steady red signal at a traffic-actuated electric traffic-control
2626 signal, as described by Section 544.0075, may proceed if:
2727 (1) the traffic-actuated electric traffic-control
2828 signal fails to register the motorcycle or bicycle;
2929 (2) the driver comes to a full and complete stop at the
3030 intersection, exercises due care as provided law, and
3131 (3) proceeds with caution through the intersection
3232 when it is safe to travel through the intersection.
3333 SECTION 2. This Act takes effect September 1, 2021.
