| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. |
|---|
| 10 | 10 | | Section 544.007, Transportation Code, is amended by amending |
|---|
| 11 | 11 | | Subsection (d) and adding Subsection (d-1) to read as follows: |
|---|
| 12 | 12 | | (d) An operator of a vehicle facing only a steady red signal |
|---|
| 13 | 13 | | shall stop at a clearly marked stop line. In the absence of a stop |
|---|
| 14 | 14 | | line, the operator shall stop before entering the crosswalk on the |
|---|
| 15 | 15 | | near side of the intersection. Except as provided by Subsection |
|---|
| 16 | 16 | | (d-1), a [A] vehicle that is not turning shall remain standing until |
|---|
| 17 | 17 | | an indication to proceed is shown. After stopping, standing until |
|---|
| 18 | 18 | | the intersection may be entered safely, and yielding right-of-way |
|---|
| 19 | 19 | | to pedestrians lawfully in an adjacent crosswalk and other traffic |
|---|
| 20 | 20 | | lawfully using the intersection, the operator may: |
|---|
| 21 | 21 | | (1) turn right; or |
|---|
| 22 | 22 | | (2) turn left, if the intersecting streets are both |
|---|
| 23 | 23 | | one-way streets and a left turn is permissible. |
|---|
| 24 | 24 | | (d-1) An operator of a motorcycle or bicycle facing only a |
|---|
| 25 | 25 | | steady red signal at a traffic-actuated electric traffic-control |
|---|
| 26 | 26 | | signal, as described by Section 544.0075, may proceed if: |
|---|
| 27 | 27 | | (1) the traffic-actuated electric traffic-control |
|---|
| 28 | 28 | | signal fails to register the motorcycle or bicycle; |
|---|
| 29 | 29 | | (2) the driver comes to a full and complete stop at the |
|---|
| 30 | 30 | | intersection, exercises due care as provided law, and |
|---|
| 31 | 31 | | (3) proceeds with caution through the intersection |
|---|
| 32 | 32 | | when it is safe to travel through the intersection. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2021. |
