| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subtitle A, Title 11, Government Code, is amended |
|---|
| 10 | 10 | | by adding Chapter 3107 to read as follows: |
|---|
| 11 | 11 | | CHAPTER 3107. TEXAS POLICE SERVICE ANIMALS MEMORIAL MONUMENT |
|---|
| 12 | 12 | | Sec. 3107.001. DEFINITIONS. In this chapter: |
|---|
| 13 | 13 | | (1) "Board" means the State Preservation Board. |
|---|
| 14 | 14 | | (2) "Committee" has the meaning assigned by Section |
|---|
| 15 | 15 | | 3105.002. |
|---|
| 16 | 16 | | (3) "Monument" means the Texas Police Service Animals |
|---|
| 17 | 17 | | Memorial Monument. |
|---|
| 18 | 18 | | (4) "Police service animal" has the meaning assigned by |
|---|
| 19 | 19 | | Section 38.151, Penal Code. |
|---|
| 20 | 20 | | Sec. 3107.002. TEXAS POLICE SERVICE ANIMALS MEMORIAL |
|---|
| 21 | 21 | | MONUMENT. The board shall establish a Texas Police Service Animals |
|---|
| 22 | 22 | | Memorial Monument on the grounds of the Capitol Complex adjacent to |
|---|
| 23 | 23 | | the Texas Peace Officers' Memorial Monument to recognize and honor |
|---|
| 24 | 24 | | police service animals that were killed in the line of duty. |
|---|
| 25 | 25 | | Sec. 3107.003. MAINTENANCE OF MONUMENT. (a) The board is |
|---|
| 26 | 26 | | responsible for the maintenance of the monument. The board may |
|---|
| 27 | 27 | | raise money from private or public entities for the continued |
|---|
| 28 | 28 | | maintenance and update of the monument. The board shall: |
|---|
| 29 | 29 | | (1) establish a schedule for the maintenance of the |
|---|
| 30 | 30 | | monument; and |
|---|
| 31 | 31 | | (2) select persons to maintain the monument. |
|---|
| 32 | 32 | | (b) An entity that collects funds for the maintenance and |
|---|
| 33 | 33 | | improvement of the monument shall send that money to the board to be |
|---|
| 34 | 34 | | deposited in the Capitol fund account. |
|---|
| 35 | 35 | | Sec. 3107.004. ACCOUNT. (a) Money contributed to the state |
|---|
| 36 | 36 | | for a purpose related to the monument shall be deposited by the |
|---|
| 37 | 37 | | board in the Capitol fund to the credit of a separate |
|---|
| 38 | 38 | | interest-bearing account established for the monument. |
|---|
| 39 | 39 | | (b) Notwithstanding any other law, income from investments of |
|---|
| 40 | 40 | | money in the account shall be deposited to the credit of the |
|---|
| 41 | 41 | | account. |
|---|
| 42 | 42 | | (c) Money in the account may be used only for the purposes |
|---|
| 43 | 43 | | prescribed by Section 3107.003. |
|---|
| 44 | 44 | | SECTION 2. This Act takes effect September 1, 2021. |
