| 7 | 7 | | commissions in certain counties. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION1. Chapter 89, Local Government Code, is amended by |
|---|
| 10 | 10 | | adding Section 89.007 to read as follows: |
|---|
| 11 | 11 | | Sec. 89.007. TERMS OF APPOINTED MEMBERS OF BOARDS AND |
|---|
| 12 | 12 | | COMMISSIONS IN CERTAIN COUNTIES. (a) This section applies only to a |
|---|
| 13 | 13 | | county that: |
|---|
| 14 | 14 | | (1) has a population of less than 400,000; and |
|---|
| 15 | 15 | | (2) contains a municipality with a population of more |
|---|
| 16 | 16 | | than 300,000. |
|---|
| 17 | 17 | | (b) Notwithstanding any other law, members who are |
|---|
| 18 | 18 | | appointed to a board or commission by the commissioners court of a |
|---|
| 19 | 19 | | county shall serve no more than 12 consecutive years on the board or |
|---|
| 20 | 20 | | commission to which they are appointed. If the expiration of 12 |
|---|
| 21 | 21 | | years of service of a person's term occurs during an unexpired term, |
|---|
| 22 | 22 | | that person shall have the right to serve until the end of that |
|---|
| 23 | 23 | | unexpired term. A person that has termed-out of service on a board |
|---|
| 24 | 24 | | or commission shall only have the right to reapply and serve on the |
|---|
| 25 | 25 | | termed-out board or commission after the passage of one full term of |
|---|
| 26 | 26 | | that particular board or commission. |
|---|
| 27 | 27 | | SECTION 2. The change in law made by this Act does not |
|---|
| 28 | 28 | | affect the entitlement of a member serving on a board or commission |
|---|
| 29 | 29 | | immediately before the effective date of this Act to continue to |
|---|
| 30 | 30 | | serve for the remainder of the member's term. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2021. |
