44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the terms of appointed members of boards and
77 commissions in certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION1. Chapter 89, Local Government Code, is amended by
1010 adding Section 89.007 to read as follows:
1111 Sec. 89.007. TERMS OF APPOINTED MEMBERS OF BOARDS AND
1212 COMMISSIONS IN CERTAIN COUNTIES. (a) This section applies only to a
1313 county that:
1414 (1) has a population of less than 400,000; and
1515 (2) contains a municipality with a population of more
1616 than 300,000.
1717 (b) Notwithstanding any other law, members who are
1818 appointed to a board or commission by the commissioners court of a
1919 county shall serve no more than 12 consecutive years on the board or
2020 commission to which they are appointed. If the expiration of 12
2121 years of service of a person's term occurs during an unexpired term,
2222 that person shall have the right to serve until the end of that
2323 unexpired term. A person that has termed-out of service on a board
2424 or commission shall only have the right to reapply and serve on the
2525 termed-out board or commission after the passage of one full term of
2626 that particular board or commission.
2727 SECTION 2. The change in law made by this Act does not
2828 affect the entitlement of a member serving on a board or commission
2929 immediately before the effective date of this Act to continue to
3030 serve for the remainder of the member's term.
3131 SECTION 3. This Act takes effect September 1, 2021.
