55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of individual graduation committees and other
88 alternative methods to satisfy certain public high school
99 graduation requirements.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 12.104(b-2) and (b-3), Education Code,
1212 are amended to read as follows:
1313 (b-2) An open-enrollment charter school is subject to the
1414 requirement to establish an individual graduation committee under
1515 Section 28.0258. [This subsection expires September 1, 2023.]
1616 (b-3) An open-enrollment charter school is subject to the
1717 graduation qualification procedure established by the commissioner
1818 under Section 28.02541. [This subsection expires September 1,
1919 2023.]
2020 SECTION 2. Section 28.025(c-6), Education Code, is amended
2121 to read as follows:
2222 (c-6) Notwithstanding Subsection (c), a person may receive
2323 a diploma if the person is eligible for a diploma under Section
2424 28.0258. [This subsection expires September 1, 2023.]
2525 SECTION 3. Section 28.02591(a), Education Code, is amended
2626 to read as follows:
2727 (a) The Texas Higher Education Coordinating Board, in
2828 coordination with the agency, shall collect longitudinal data
2929 relating to the post-graduation pursuits of each student who is
3030 awarded a diploma based on the determination of an individual
3131 graduation committee under Section 28.0258, [as that section
3232 existed before September 1, 2023,] including whether the student:
3333 (1) enters the workforce;
3434 (2) enrolls in an associate degree or certificate
3535 program at a public or private institution of higher education;
3636 (3) enrolls in a bachelor's degree program at a public
3737 or private institution of higher education; or
3838 (4) enlists in the armed forces of the United States or
3939 the Texas National Guard.
4040 SECTION 4. Sections 39.025(a-3) and (a-5), Education Code,
4141 are amended to read as follows:
4242 (a-3) A student who, after retaking an end-of-course
4343 assessment instrument for Algebra I or English II, has failed to
4444 perform satisfactorily as required by Subsection (a), but who
4545 receives a score of proficient on the Texas Success Initiative
4646 (TSI) diagnostic assessment for the corresponding subject for which
4747 the student failed to perform satisfactorily on the end-of-course
4848 assessment instrument satisfies the requirement concerning the
4949 Algebra I or English II end-of-course assessment, as applicable.
5050 [This subsection expires September 1, 2023.]
5151 (a-5) Notwithstanding Subsection (a), a student who has
5252 failed to perform satisfactorily on end-of-course assessment
5353 instruments in the manner provided under this section may receive a
5454 high school diploma if the student has qualified for graduation
5555 under Section 28.0258. [This subsection expires September 1, 2023.]
5656 SECTION 5. Sections 28.02541(g), 28.0258(l), and
5757 28.0259(e), Education Code, are repealed.
5858 SECTION 6. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2021.
