77 relating to the employment of certified school counselors by school
88 districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 33.002, Education Code, is amended to
1111 read as follows:
1212 Sec. 33.002. [CERTIFIED] SCHOOL COUNSELOR TO STUDENT RATIO;
1313 DISTRIBUTION OF FUNDS FOR COUNSELING PROGRAMS. (a) In this
1414 section, "school counselor" means a school counselor certified
1515 under Subchapter B, Chapter 21.
1616 (a-1) From funds appropriated for the purpose or other funds
1717 that may be used for the purpose, the commissioner shall distribute
1818 funds for programs under this subchapter. In distributing those
1919 funds, the commissioner shall give preference to [a school district
2020 that received funds under this subsection for the preceding school
2121 year and then to] the districts that have the highest concentration
2222 of students at risk of dropping out of school, as described by
2323 Section 29.081. To receive funds for the program, a school district
2424 must apply to the commissioner. For each school year that a school
2525 district receives funds under this subsection, the district shall
2626 allocate an amount of local funds for school guidance and
2727 counseling programs that is equal to or greater than the amount of
2828 local funds that the school district allocated for that purpose
2929 during the preceding school year. Funds distributed under this
3030 subsection are in addition to any other funds available for
3131 programs under this subchapter, including funds provided under
3232 Section 48.2641 [This section applies only to a school district
3333 that receives funds as provided by this subsection].
3434 (b) Beginning with the 2029-2030 school year, a [A] school
3535 district with 300 [500] or more students in enrollment [enrolled in
3636 elementary school grades] shall employ a school counselor
3737 [certified under the rules of the State Board for Educator
3838 Certification] for each [elementary] school in the district. A
3939 school district shall employ at least one school counselor for
4040 every 300 [500 elementary school] students in the district.
4141 (b-1) Beginning with the 2027-2028 school year, a school
4242 district with 350 or more students in enrollment shall employ a
4343 school counselor for each school in the district. A school district
4444 shall employ at least one school counselor for every 350 students in
4545 the district. This subsection expires September 1, 2029.
4646 (b-2) Beginning with the 2025-2026 school year, a school
4747 district with 400 or more students in enrollment shall employ a
4848 school counselor for each school in the district. A school district
4949 shall employ at least one school counselor for every 400 students in
5050 the district. This subsection expires September 1, 2027.
5151 (b-3) Beginning with the 2023-2024 school year, a school
5252 district with 450 or more students in enrollment shall employ a
5353 school counselor for each school in the district. A school district
5454 shall employ at least one school counselor for every 450 students in
5555 the district. This subsection expires September 1, 2025.
5656 (b-4) A school district with 500 or more students in
5757 enrollment shall employ a school counselor for each school in the
5858 district. A school district shall employ at least one school
5959 counselor for every 500 students in the district. This subsection
6060 expires September 1, 2023.
6161 (c) Beginning with the 2029-2030 school year, a [A] school
6262 district with fewer than 300 [500] students in enrollment [enrolled
6363 in elementary school grades] shall provide guidance and counseling
6464 services to [elementary school] students by:
6565 (1) employing a part-time school counselor [certified
6666 under the rules of the State Board for Educator Certification];
6767 (2) employing a part-time teacher certified as a
6868 school counselor under Subchapter B, Chapter 21 [the rules of the
6969 State Board for Educator Certification]; or
7070 (3) entering into a shared services arrangement
7171 agreement with one or more school districts to share a school
7272 counselor [certified under the rules of the State Board for
7373 Educator Certification].
7474 (c-1) Beginning with the 2027-2028 school year, a school
7575 district with fewer than 350 students in enrollment shall provide
7676 guidance and counseling services to students by:
7777 (1) employing a part-time school counselor;
7878 (2) employing a part-time teacher certified as a
7979 school counselor under Subchapter B, Chapter 21; or
8080 (3) entering into a shared services arrangement
8181 agreement with one or more school districts to share a school
8282 counselor.
8383 (c-2) Subsection (c-1) and this subsection expire September
8484 1, 2029.
8585 (c-3) Beginning with the 2025-2026 school year, a school
8686 district with fewer than 400 students in enrollment shall provide
8787 guidance and counseling services to students by:
8888 (1) employing a part-time school counselor;
8989 (2) employing a part-time teacher certified as a
9090 school counselor under Subchapter B, Chapter 21; or
9191 (3) entering into a shared services arrangement
9292 agreement with one or more school districts to share a school
9393 counselor.
9494 (c-4) Subsection (c-3) and this subsection expire September
9595 1, 2027.
9696 (c-5) Beginning with the 2023-2024 school year, a school
9797 district with fewer than 450 students in enrollment shall provide
9898 guidance and counseling services to students by:
9999 (1) employing a part-time school counselor;
100100 (2) employing a part-time teacher certified as a
101101 school counselor under Subchapter B, Chapter 21; or
102102 (3) entering into a shared services arrangement
103103 agreement with one or more school districts to share a school
104104 counselor.
105105 (c-6) Subsection (c-5) and this subsection expire September
106106 1, 2025.
107107 (c-7) A school district with fewer than 500 students in
108108 enrollment shall provide guidance and counseling services to
109109 students by:
110110 (1) employing a part-time school counselor;
111111 (2) employing a part-time teacher certified as a
112112 school counselor under Subchapter B, Chapter 21; or
113113 (3) entering into a shared services arrangement
114114 agreement with one or more school districts to share a school
115115 counselor.
116116 (c-8) Subsection (c-7) and this subsection expire September
117117 1, 2023.
118118 SECTION 2. Subchapter F, Chapter 48, Education Code, is
119119 amended by adding Section 48.2641 to read as follows:
120120 Sec. 48.2641. ADDITIONAL STATE AID FOR CERTIFIED SCHOOL
121121 COUNSELORS. (a) For each school year, from funds that may be used
122122 for the purpose, a school district is entitled to state aid in an
123123 amount, as determined by the commissioner, sufficient to assist the
124124 district in employing the number of certified school counselors
125125 required by Section 33.002.
126126 (b) The commissioner shall adopt rules as necessary to
127127 administer this section.
128128 SECTION 3. This Act applies beginning with the 2021-2022
129129 school year.
130130 SECTION 4. This Act takes effect immediately if it receives
131131 a vote of two-thirds of all the members elected to each house, as
132132 provided by Section 39, Article III, Texas Constitution. If this
133133 Act does not receive the vote necessary for immediate effect, this
134134 Act takes effect September 1, 2021.
