55 AN ACT
66 relating to the distribution of emergency health resources by the
77 state.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 161, Health and Safety Code, Subchapter
1010 A is amended by adding Section 161.0110 to read as follows:
1111 Sec. 161.0110. PANDEMIC VACCINE DISTRIBUTION. (a) The
1212 state shall proportionally distribute to designated providers in
1313 each county in the state any vaccine or immunizing agent received or
1414 manufactured for the purpose of responding to a pandemic, state
1515 epidemic, or public health disaster under Section 81.003, Health
1616 and Safety Code, based on:
1717 (1) the county population size;
1818 (2) the percentage of the county population currently
1919 infected compared to the state population currently infected; and
2020 (3) the percentage of the county population who has
2121 died as a direct or in-direct result of the disease compared to the
2222 total number of people in the state who have died as a direct or
2323 in-direct result of the disease.
2424 (b) If the state has a limited supply of vaccines or
2525 immunizing agents for distribution or has received an additional
2626 supply of vaccines or immunizing agents for distribution and has
2727 given priority designation to specific professions or groups of
2828 people to receive the vaccine or immunizing agent, the state shall
2929 distribute the vaccines or immunizing agents proportionally based
3030 on:
3131 (1) the county population size;
3232 (2) the percentage of the county population receiving
3333 priority designation by the state compared to the total state
3434 population receiving priority designation by the state;
3535 (3) the percentage of the county population currently
3636 infected compared to the state population currently infected; and
3737 (4) the percentage of the county population who has
3838 died as a direct or in-direct result of the disease compared to the
3939 total number of people in the state who have died as a direct or
4040 in-direct result of the disease.
4141 (c) Sections (a-b) only apply to counties that are located
4242 in an area with a declared disaster under Section 418.014, 418.108,
4343 Government Code, as a result of a pandemic, state epidemic, or
4444 public health disaster under Section 81.003, Health and Safety
4545 Code,.
4646 SECTION 2. Section 418.017, Government Code, is amended by
4747 adding subsections (d-f) to read as follows:
4848 Sec. 418.017 USE OF PUBLIC AND PRIVATE RESOURCES. (a) The
4949 governor may use all available resources of state government and of
5050 political subdivisions that are reasonably necessary to cope with a
5151 disaster.
5252 (b) The governor may temporarily reassign resources,
5353 personnel, or functions of state executive departments and agencies
5454 or their units for the purpose of performing or facilitating
5555 emergency services.
5656 (c) The governor may commandeer or use any private property
5757 if the governor finds it necessary to cope with a disaster, subject
5858 to the compensation requirements of this chapter.
5959 (d) Any personal protective equipment, sanitation equipment
6060 or any other public or private resource designated for responding
6161 to a pandemic, state epidemic or public health disaster under
6262 Section 81.003, Health and Safety Code, must be proportionately
6363 distributed to each county based on:
6464 (1) the county population size;
6565 (2) the percentage of the county population currently
6666 infected compared to the state population currently infected; and
6767 (3) the percentage of the county population who has
6868 died as a direct or in-direct result of the disease compared to the
6969 total number of people in the state who have died as a direct or
7070 in-direct result of the disease.
7171 (e) If the state has a limited supply or an additional
7272 supply of personal protective equipment, sanitation equipment or
7373 any other public or private resource designated for responding to a
7474 pandemic, state epidemic or public health disaster under Section
7575 81.003, Health and Safety Code, and has given priority designation
7676 to specific professions or groups of people to receive designated
7777 resources, the state must proportionately distributed resources to
7878 each county based on:
7979 (1) the county population size;
8080 (2) the percentage of the county population receiving
8181 priority designation by the state compared to the total state
8282 population receiving priority designation by the state;
8383 (3) the percentage of the county population currently
8484 infected compared to the state population currently infected; and
8585 (4) the percentage of the county population who has
8686 died as a direct or in-direct result of the disease compared to the
8787 total number of people in the state who have died as a direct or
8888 in-direct result of the disease.
8989 (f) Sections (d-e) only apply to counties that are located
9090 in an area with a declared disaster under Section 418.014, 418.108,
9191 as a result of a pandemic, state epidemic, or health crisis.
9292 Section 3. This act takes effect immediately if it receives
9393 a vote of two-thirds of all the members elected to each house, as
9494 provided by Section 39, Article III, Texas Constitution. If this
9595 Act does not receive the vote necessary for immediate effect, this
9696 Act takes effect September 1, 2021.
