77 relating to a statewide opioid settlement agreement.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 403, Government Code, is amended by
1010 adding Subchapter R to read as follows:
1111 SUBCHAPTER R. STATEWIDE OPIOID SETTLEMENT AGREEMENT
1212 Sec. 403.501. DEFINITIONS. In this chapter:
1313 (1) "Council" means the Texas Opioid Council created
1414 as described by the term sheet to manage the distribution of funds
1515 from the opioid abatement fund in accordance with a statewide
1616 opioid settlement agreement.
1717 (2) "Governmental entity" means:
1818 (A) this state and each of its departments,
1919 agencies, divisions, boards, commissions, and instrumentalities;
2020 and
2121 (B) a political subdivision of this state,
2222 including a county, municipality, special district, school
2323 district, junior college district, and housing authority.
2424 (3) "Released claim" means a claim that has been
2525 released under a statewide opioid settlement agreement.
2626 (4) "Released entity" means an entity against which a
2727 claim has been released under a statewide opioid settlement
2828 agreement.
2929 (5) "Statewide opioid settlement agreement" means all
3030 settlement agreements and related documents entered into by this
3131 state through the attorney general and opioid manufacturers,
3232 distributors, or retailers relating to illegal conduct in the
3333 marketing, promotion, sale, distribution, and dispensing of
3434 opioids that provide relief for this state and political
3535 subdivisions of this state.
3636 (6) "Term sheet" means the Texas Opioid Abatement Fund
3737 Council and Settlement Allocation Term Sheet agreed to by this
3838 state and political subdivisions of this state.
3939 Sec. 403.502. SETTLEMENT RECORDS. The attorney general and
4040 comptroller shall maintain a copy of a statewide opioid settlement
4141 agreement, including any amendments to the agreement, and make the
4242 copy available on the attorney general's and comptroller's Internet
4343 websites.
4444 Sec. 403.503. TEXAS OPIOID ABATEMENT FUND COUNCIL. The
4545 council is administratively attached to the comptroller's office.
4646 The comptroller shall provide the staff and facilities necessary to
4747 assist the council in performing its duties.
4848 Sec. 403.504. DISTRIBUTION OF FUNDS. Funds obtained under
4949 a statewide opioid settlement agreement shall be distributed in
5050 accordance with the term sheet.
5151 Sec. 403.505. EFFECT OF SETTLEMENT ON RELEASED CLAIMS. (a)
5252 A governmental entity may not bring a released claim against a
5353 released entity.
5454 (b) A court shall dismiss with prejudice a pending action
5555 asserting a released claim against a released entity brought by a
5656 governmental entity.
5757 SECTION 2. This Act takes effect September 1, 2021.
