| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 48.0051, Education Code, is amended by | |
| 12 | 12 | amending Subsection (a) and adding Subsection (a-2) to read as | |
| 13 | 13 | follows: | |
| 14 | 14 | (a) Subject to Subsection (a-1), the commissioner shall | |
| 15 | 15 | adjust the average daily attendance of a school district or | |
| 16 | 16 | open-enrollment charter school under Section 48.005 in the manner | |
| 17 | 17 | provided by Subsection (b) if the district or school: | |
| 18 | 18 | (1) provides the minimum number of minutes of | |
| 19 | 19 | operational and instructional time required under Section 25.081 | |
| 20 | 20 | and commissioner rules adopted under that section over at least 180 | |
| 21 | 21 | days of instruction as provided by Subsection (a-2); and | |
| 22 | 22 | (2) offers an additional 30 days of half-day | |
| 23 | 23 | instruction for students enrolled in prekindergarten through fifth | |
| 24 | 24 | grade. | |
| 25 | 25 | (a-2) To be eligible for the adjustment to the average daily | |
| 26 | 26 | attendance under Subsection (a), a school district or | |
| 27 | 27 | open-enrollment charter school is only required to provide the | |
| 28 | 28 | minimum number of minutes of operational and instructional time | |
| 29 | 29 | described by Subsection (a)(1) over at least 180 days of | |
| 30 | 30 | instruction for students to whom the district or school offers the | |
| 31 | 31 | additional 30 days of half-day instruction. | |
| 32 | 32 | SECTION 2. This Act takes effect September 1, 2021. |
