55 AN ACT
66 relating to Firefighters Enrolled in Fire Science Courses
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sec 54.353, Education Code, is amended to read as
99 follows: (a) The governing board of an institution of higher
1010 education shall exempt from the payment of tuition and laboratory
1111 fees any student enrolled in one or more courses offered as part of
1212 a fire science curriculum who:
1313 (1) is employed as a firefighter by a political subdivision
1414 of this state; or
1515 (2) a member in good standing in a volunteer firefighter
1616 department, registered with Texas Forest Service and providing 911
1717 service to a designated area: is currently, and has been for at
1818 least one year, an active member of an organized volunteer fire
1919 department participating in the Texas Emergency Services
2020 Retirement System or a retirement system established under the
2121 Texas Local Fire Fighters Retirement Act (Article 6243e, Vernon's
2222 Texas Civil Statutes) and who holds:
2323 (i) attends at least 20 hours of annual training;
2424 (ii) attends or provides support services for at
2525 least 25 percent of the departments emergencies in a
2626 calendar year; and
2727 (iii) and who holds:
2828 (A) an Accredited Advanced level of certification, or
2929 an equivalent successor certification, under the State
3030 Firemen's and Fire Marshals' Association of Texas volunteer
3131 certification program; or
3232 (B) Phase V (Firefighter II) certification, or an
3333 equivalent successor certification, under the Texas
3434 Commission on Fire Protection's voluntary certification
3535 program under Section 419.071, Government Code.
3636 (b) An exemption provided under this section does not apply
3737 to deposits that may be required in the nature of security for the
3838 return or proper care of property loaned for the use of students.
3939 (c) Notwithstanding Subsection (a), a student who for a
4040 semester or term at an institution of higher education receives an
4141 exemption under this section may continue to receive the exemption
4242 for a subsequent semester or term at any institution only if the
4343 student makes satisfactory academic progress toward a degree or
4444 certificate at that institution as determined by the institution
4545 for purposes of financial aid.
4646 (d) Notwithstanding Subsection (a), the exemption provided
4747 under this section does not apply to any amount of additional
4848 tuition the institution elects to charge a resident undergraduate
4949 student under Section 54.014(a) or (f).
5050 (e) Notwithstanding Subsection (a), the exemption provided
5151 under this section does not apply to any amount of tuition the
5252 institution charges a graduate student in excess of the amount of
5353 tuition charged to similarly situated graduate students because the
5454 student has a number of semester credit hours of doctoral work in
5555 excess of the applicable number provided by Section 61.059(l)(1) or
5656 (2).
5757 (f) The Texas Higher Education Coordinating Board shall
5858 adopt:
5959 (1) rules governing the granting or denial of an
6060 exemption under this section, including rules relating to the
6161 determination of a student's eligibility for an exemption;
6262 and
6363 (2) a uniform listing of degree programs covered by
6464 the exemption under this section.
6565 SECTION 2. This Act takes effect September 1, 2021
