46 AN ACT
57 relating to procurement of a contingent fee contract for legal
68 services by certain governmental entities.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 2254.101(2), Government Code, is amended
911 to read as follows:
1012 (2) "Contingent fee contract" means a contract for
1113 legal services under which the amount or the payment of the fee for
1214 the services is contingent in whole or in part on the outcome of the
1315 matter for which the services were obtained. The term includes an
1416 amendment to a contract for legal services described by this
1517 subdivision if the amendment:
1618 (A) changes the scope of representation; or
1719 (B) may result in:
1820 (i) the filing of an action; or
1921 (ii) the amending of a petition in an
2022 existing action.
2123 SECTION 2. The changes in law made by this Act apply only to
2224 a contract or contract amendment entered into on or after the
2325 effective date of this Act.
2426 SECTION 3. This Act takes effect immediately if it receives
2527 a vote of two-thirds of all the members elected to each house, as
2628 provided by Section 39, Article III, Texas Constitution. If this
2729 Act does not receive the vote necessary for immediate effect, this
2830 Act takes effect September 1, 2021.
