6 | 6 | | relating to the approval of certain private or independent |

7 | 7 | | institutions of higher education to participate in the tuition |
---|
8 | 8 | | equalization grant program. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 61.222, Education Code, is amended by |
---|
11 | 11 | | adding Subsection (e) to read as follows: |
---|
12 | 12 | | (e) Notwithstanding any other provision of this section, |
---|
13 | 13 | | the coordinating board may not approve an institution under this |
---|
14 | 14 | | section unless, for the preceding academic year: |
---|
15 | 15 | | (1) provided there is another eligible institution in |
---|
16 | 16 | | the county and if: |
---|
17 | 17 | | (i) the institution's average graduation |
---|
18 | 18 | | rate for students graduating within six years of their initial |
---|
19 | 19 | | enrollment at the institution is equal to or greater than the |
---|
20 | 20 | | average six-year graduation rate of institutions of higher |
---|
21 | 21 | | education and private or independent institutions of higher |
---|
22 | 22 | | education as determined by the coordinating board; or |
---|
23 | 23 | | (ii) the average amount of student loan |
---|
24 | 24 | | debt at graduation from an undergraduate program at the institution |
---|
25 | 25 | | is equal to or less than the average amount of student loan debt at |
---|
26 | 26 | | graduation from undergraduate programs at institutions of higher |
---|
27 | 27 | | education and private or independent institutions of higher |
---|
28 | 28 | | education as determined by the coordinating board. |
---|
29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
---|
30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 33 | | Act takes effect September 1, 2021. |
