46 AN ACT
57 relating to maintaining and distributing certain Medicaid managed
68 care directories.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter A, Chapter 533, Government Code, is
911 amended by adding Section 533.00751 to read as follows:
1012 Sec. 533.00751. RECIPIENT DIRECTORY. The commission shall
1113 in accordance with a single source of truth design:
1214 (1) maintain an accurate electronic directory of
1315 contact information for each recipient enrolled in a managed care
1416 plan offered by a Medicaid managed care organization under this
1517 chapter, including, to the extent feasible, each recipient's:
1618 (A) home, work, and mobile telephone numbers;
1719 (B) e-mail address; and
1820 (C) home and work addresses; and
1921 (2) ensure that each Medicaid managed care
2022 organization and enrollment broker participating in the Medicaid
2123 managed care program update the electronic directory required under
2224 Subdivision (1) in real time.
2325 SECTION 2. Section 533.0063(b), Government Code, is amended
2426 to read as follows:
2527 (b) A [Except as provided by Subsection (c), a] managed care
2628 organization is required to send a paper form of the organization's
2729 provider network directory for the program only to a recipient who
2830 requests to receive the directory in paper form.
2931 SECTION 3. Section 533.0063(c), Government Code, is
3032 repealed.
3133 SECTION 4. (a) The Health and Human Services Commission
3234 shall, in a contract between the commission and a managed care
3335 organization under Chapter 533, Government Code, that is entered
3436 into or renewed on or after the effective date of this Act, require
3537 that the managed care organization comply with Section 533.00751,
3638 Government Code, as added by this Act.
3739 (b) The Health and Human Services Commission shall seek to
3840 amend contracts entered into with managed care organizations under
3941 Chapter 533, Government Code, before the effective date of this Act
4042 to require those managed care organizations to comply with Section
4143 533.00751, Government Code, as added by this Act. To the extent of
4244 a conflict between that section and a provision of a contract with a
4345 managed care organization entered into before the effective date of
4446 this Act, the contract provision prevails.
4547 SECTION 5. If before implementing any provision of this Act
4648 a state agency determines that a waiver or authorization from a
4749 federal agency is necessary for implementation of that provision,
4850 the agency affected by the provision shall request the waiver or
4951 authorization and may delay implementing that provision until the
5052 waiver or authorization is granted.
5153 SECTION 6. This Act takes effect immediately if it receives
5254 a vote of two-thirds of all the members elected to each house, as
5355 provided by Section 39, Article III, Texas Constitution. If this
5456 Act does not receive the vote necessary for immediate effect, this
5557 Act takes effect September 1, 2021.
