4	6		AN ACT
5	7		relating to maintaining and distributing certain Medicaid managed
6	8		care directories.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Subchapter A, Chapter 533, Government Code, is
9	11		amended by adding Section 533.00751 to read as follows:
10	12		Sec. 533.00751. RECIPIENT DIRECTORY. The commission shall
11	13		in accordance with a single source of truth design:
12	14		(1) maintain an accurate electronic directory of
13	15		contact information for each recipient enrolled in a managed care
14	16		plan offered by a Medicaid managed care organization under this
15	17		chapter, including, to the extent feasible, each recipient's:
16	18		(A) home, work, and mobile telephone numbers;
17	19		(B) e-mail address; and
18	20		(C) home and work addresses; and
19	21		(2) ensure that each Medicaid managed care
20	22		organization and enrollment broker participating in the Medicaid
21	23		managed care program update the electronic directory required under
22	24		Subdivision (1) in real time.
23	25		SECTION 2. Section 533.0063(b), Government Code, is amended
24	26		to read as follows:
25	27		(b) A [Except as provided by Subsection (c), a] managed care
26	28		organization is required to send a paper form of the organization's
27	29		provider network directory for the program only to a recipient who
28	30		requests to receive the directory in paper form.
29	31		SECTION 3. Section 533.0063(c), Government Code, is
30	32		repealed.
31	33		SECTION 4. (a) The Health and Human Services Commission
32	34		shall, in a contract between the commission and a managed care
33	35		organization under Chapter 533, Government Code, that is entered
34	36		into or renewed on or after the effective date of this Act, require
35	37		that the managed care organization comply with Section 533.00751,
36	38		Government Code, as added by this Act.
37	39		(b) The Health and Human Services Commission shall seek to
38	40		amend contracts entered into with managed care organizations under
39	41		Chapter 533, Government Code, before the effective date of this Act
40	42		to require those managed care organizations to comply with Section
41	43		533.00751, Government Code, as added by this Act. To the extent of
42	44		a conflict between that section and a provision of a contract with a
43	45		managed care organization entered into before the effective date of
44	46		this Act, the contract provision prevails.
45	47		SECTION 5. If before implementing any provision of this Act
46	48		a state agency determines that a waiver or authorization from a
47	49		federal agency is necessary for implementation of that provision,
48	50		the agency affected by the provision shall request the waiver or
49	51		authorization and may delay implementing that provision until the
50	52		waiver or authorization is granted.
51	53		SECTION 6. This Act takes effect immediately if it receives
52	54		a vote of two-thirds of all the members elected to each house, as
53	55		provided by Section 39, Article III, Texas Constitution. If this
54	56		Act does not receive the vote necessary for immediate effect, this
55	57		Act takes effect September 1, 2021.
