| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 204.002(a), Property Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (a) This chapter applies only to a residential real estate | |
| 13 | 13 | subdivision, excluding a condominium development governed by Title | |
| 14 | 14 | 7, Property Code, that is located in whole or in part: | |
| 15 | 15 | (1) in a county with a population of 3.3 million or | |
| 16 | 16 | more; | |
| 17 | 17 | (2) in a county with a population of not less than | |
| 18 | 18 | 285,000 and not more than 360,000 [300,000] that is adjacent to the | |
| 19 | 19 | Gulf of Mexico and that is adjacent to a county having a population | |
| 20 | 20 | of 3.3 million or more; or | |
| 21 | 21 | (3) in a county with a population of 275,000 or more | |
| 22 | 22 | that: | |
| 23 | 23 | (A) is adjacent to a county with a population of | |
| 24 | 24 | 3.3 million or more; and | |
| 25 | 25 | (B) contains part of a national forest. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2021. |
