55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of certain physicians to provide and
88 receive remuneration for workers' compensation health care
99 services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 408.023(r), Labor Code, is amended to
1212 read as follows:
1313 (r) Notwithstanding the waiver or expiration of Subsections
1414 (a)-(g) and (i), there may be no direct or indirect provision of
1515 health care under this subtitle and rules adopted under this
1616 subtitle, and no direct or indirect receipt of remuneration under
1717 this subtitle and rules adopted under this subtitle by a doctor who:
1818 (1) before September 1, 2007:
1919 (A) was removed or deleted from the list of
2020 approved doctors either by action of the Texas Workers'
2121 Compensation Commission or the division or by agreement with the
2222 doctor;
2323 (B) was not admitted to the list of approved
2424 doctors either by action of the Texas Workers' Compensation
2525 Commission or the division or by agreement with the doctor;
2626 (C) was suspended from the list of approved
2727 doctors either by action of the Texas Workers' Compensation
2828 Commission or the division or by agreement with the doctor; or
2929 (D) had the doctor's license to practice
3030 suspended by the appropriate licensing agency, including a
3131 suspension that was stayed, deferred, or probated, or voluntarily
3232 relinquished the license to practice; and
3333 (2) has [was] not been reinstated or restored by the
3434 Texas Workers' Compensation Commission or the division to:
3535 (A) the list of approved doctors; or
3636 (B) the workers' compensation system [before
3737 September 1, 2007].
3838 SECTION 2. This Act takes effect September 1, 2021.
