| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 408.023(r), Labor Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (r) Notwithstanding the waiver or expiration of Subsections |
|---|
| 14 | 14 | | (a)-(g) and (i), there may be no direct or indirect provision of |
|---|
| 15 | 15 | | health care under this subtitle and rules adopted under this |
|---|
| 16 | 16 | | subtitle, and no direct or indirect receipt of remuneration under |
|---|
| 17 | 17 | | this subtitle and rules adopted under this subtitle by a doctor who: |
|---|
| 18 | 18 | | (1) before September 1, 2007: |
|---|
| 19 | 19 | | (A) was removed or deleted from the list of |
|---|
| 20 | 20 | | approved doctors either by action of the Texas Workers' |
|---|
| 21 | 21 | | Compensation Commission or the division or by agreement with the |
|---|
| 22 | 22 | | doctor; |
|---|
| 23 | 23 | | (B) was not admitted to the list of approved |
|---|
| 24 | 24 | | doctors either by action of the Texas Workers' Compensation |
|---|
| 25 | 25 | | Commission or the division or by agreement with the doctor; |
|---|
| 26 | 26 | | (C) was suspended from the list of approved |
|---|
| 27 | 27 | | doctors either by action of the Texas Workers' Compensation |
|---|
| 28 | 28 | | Commission or the division or by agreement with the doctor; or |
|---|
| 29 | 29 | | (D) had the doctor's license to practice |
|---|
| 30 | 30 | | suspended by the appropriate licensing agency, including a |
|---|
| 31 | 31 | | suspension that was stayed, deferred, or probated, or voluntarily |
|---|
| 32 | 32 | | relinquished the license to practice; and |
|---|
| 33 | 33 | | (2) has [was] not been reinstated or restored by the |
|---|
| 34 | 34 | | Texas Workers' Compensation Commission or the division to: |
|---|
| 35 | 35 | | (A) the list of approved doctors; or |
|---|
| 36 | 36 | | (B) the workers' compensation system [before |
|---|
| 37 | 37 | | September 1, 2007]. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2021. |
