55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a temporary exemption from sales and use taxes for
88 certain personal protective equipment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended
1111 by adding Section 151.357 to read as follows:
1212 Sec. 151.357. PERSONAL PROTECTIVE EQUIPMENT; TEMPORARY
1313 EXEMPTION. (a) In this section, "personal protective equipment"
1414 means specialized clothing or equipment worn by a person:
1515 (1) to protect the person against potential infectious
1616 contaminants in the environment; or
1717 (2) to interfere with the transmission of particles
1818 originating from the nose or mouth of the person.
1919 (b) The sale or use of personal protective equipment is
2020 exempted from the taxes imposed by this chapter.
2121 (c) The comptroller may adopt rules to implement and
2222 administer this section.
2323 (d) This section expires January 1, 2022.
2424 SECTION 2. The change in law made by this Act does not
2525 affect taxes imposed before the effective date of this Act, and the
2626 law in effect before the effective date of this Act is continued in
2727 effect for purposes of the liability for and collection of those
2828 taxes.
2929 SECTION 3. This Act takes effect July 1, 2021, if it
3030 receives a vote of two-thirds of all the members elected to each
3131 house, as provided by Section 39, Article III, Texas Constitution.
3232 If this Act does not receive the vote necessary for effect on that
3333 date, this Act takes effect September 1, 2021.
