44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a survey developed and administered by the Texas
77 Education Agency prior to assessment instruments.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 39, Education Code, is
1010 amended by adding Section 39.040 to read as follows:
1111 Sec. 39.040. COVID-19 ASSESSMENT INSTRUMENT SURVEY. (a)
1212 The agency, in consultation with Texas A&M University-Commerce,
1313 parent teacher associations, interested school districts, and
1414 other interested parties shall develop and administer a survey to
1515 each student immediately prior to the administration to the student
1616 of an assessment instrument required under Section 39.023.
1717 (b) A survey administered under this section must:
1818 (1) address the student's experience during the
1919 coronavirus disease (COVID-19) pandemic, including problems or
2020 issues with Internet connectivity or access experienced by the
2121 student;
2222 (2) collect information on the socioeconomic status of
2323 the student;
2424 (3) collect information on whether the student
2525 participated in digital and online learning or in-person learning;
2626 and
2727 (4) any additional questions the Commissioner may deem
2828 appropriate.
2929 (c) The agency shall use the results of surveys administered
3030 under this section to adopt and amend agency policies, procedures,
3131 and rules relating to the administration of assessment instruments
3232 under Section 39.023.
3333 (d) No later than November 1. 2022, the agency shall submit
3434 to the governor, the lieutenant governor, the speaker of the house
3535 of representatives, and the agency a report of the results of the
3636 survey administered under Sect. 39.040 and any recommendations for
3737 legislative or other actions.
3838 (e) This section expires September 1, 2023.
3939 SECTION 2. As soon as practicable after the effective date
4040 of this Act and before the administration during the 2021-2022
4141 school year of an assessment instrument required by Section 39.023,
4242 Education Code, the Texas Education Agency shall develop the survey
4343 required under Section 39.040, Education Code, as added by this
4444 Act.
4545 SECTION 3. This Act applies beginning with the 2021-2022
4646 school year.
4747 SECTION 4. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2021.
