| 7 | 7 | | Education Agency prior to assessment instruments. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 39, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 39.040 to read as follows: |
|---|
| 11 | 11 | | Sec. 39.040. COVID-19 ASSESSMENT INSTRUMENT SURVEY. (a) |
|---|
| 12 | 12 | | The agency, in consultation with Texas A&M University-Commerce, |
|---|
| 13 | 13 | | parent teacher associations, interested school districts, and |
|---|
| 14 | 14 | | other interested parties shall develop and administer a survey to |
|---|
| 15 | 15 | | each student immediately prior to the administration to the student |
|---|
| 16 | 16 | | of an assessment instrument required under Section 39.023. |
|---|
| 17 | 17 | | (b) A survey administered under this section must: |
|---|
| 18 | 18 | | (1) address the student's experience during the |
|---|
| 19 | 19 | | coronavirus disease (COVID-19) pandemic, including problems or |
|---|
| 20 | 20 | | issues with Internet connectivity or access experienced by the |
|---|
| 21 | 21 | | student; |
|---|
| 22 | 22 | | (2) collect information on the socioeconomic status of |
|---|
| 23 | 23 | | the student; |
|---|
| 24 | 24 | | (3) collect information on whether the student |
|---|
| 25 | 25 | | participated in digital and online learning or in-person learning; |
|---|
| 26 | 26 | | and |
|---|
| 27 | 27 | | (4) any additional questions the Commissioner may deem |
|---|
| 28 | 28 | | appropriate. |
|---|
| 29 | 29 | | (c) The agency shall use the results of surveys administered |
|---|
| 30 | 30 | | under this section to adopt and amend agency policies, procedures, |
|---|
| 31 | 31 | | and rules relating to the administration of assessment instruments |
|---|
| 32 | 32 | | under Section 39.023. |
|---|
| 33 | 33 | | (d) No later than November 1. 2022, the agency shall submit |
|---|
| 34 | 34 | | to the governor, the lieutenant governor, the speaker of the house |
|---|
| 35 | 35 | | of representatives, and the agency a report of the results of the |
|---|
| 36 | 36 | | survey administered under Sect. 39.040 and any recommendations for |
|---|
| 37 | 37 | | legislative or other actions. |
|---|
| 38 | 38 | | (e) This section expires September 1, 2023. |
|---|
| 39 | 39 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 40 | 40 | | of this Act and before the administration during the 2021-2022 |
|---|
| 41 | 41 | | school year of an assessment instrument required by Section 39.023, |
|---|
| 42 | 42 | | Education Code, the Texas Education Agency shall develop the survey |
|---|
| 43 | 43 | | required under Section 39.040, Education Code, as added by this |
|---|
| 44 | 44 | | Act. |
|---|
| 45 | 45 | | SECTION 3. This Act applies beginning with the 2021-2022 |
|---|
| 46 | 46 | | school year. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2021. |
