55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to qualifications and registration of certain voters
88 convicted of a felony.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.002(a), Election Code, is amended to
1111 read as follows:
1212 (a) In this code, "qualified voter" means a person who:
1313 (1) is 18 years of age or older;
1414 (2) is a United States citizen;
1515 (3) has not been determined by a final judgment of a
1616 court exercising probate jurisdiction to be:
1717 (A) totally mentally incapacitated; or
1818 (B) partially mentally incapacitated without the
1919 right to vote;
2020 (4) has not been finally convicted of a felony or, if
2121 so convicted, is not currently incarcerated for that offense [has:
2222 [(A) fully discharged the person's sentence,
2323 including any term of incarceration, parole, or supervision, or
2424 completed a period of probation ordered by any court; or
2525 [(B) been pardoned or otherwise released from the
2626 resulting disability to vote];
2727 (5) is a resident of this state; and
2828 (6) is a registered voter.
2929 SECTION 2. Section 13.001(a), Election Code, is amended to
3030 read as follows:
3131 (a) To be eligible for registration as a voter in this
3232 state, a person must:
3333 (1) be 18 years of age or older;
3434 (2) be a United States citizen;
3535 (3) not have been determined by a final judgment of a
3636 court exercising probate jurisdiction to be:
3737 (A) totally mentally incapacitated; or
3838 (B) partially mentally incapacitated without the
3939 right to vote;
4040 (4) not have been finally convicted of a felony or, if
4141 so convicted, must not currently be incarcerated for that offense
4242 [have:
4343 [(A) fully discharged the person's sentence,
4444 including any term of incarceration, parole, or supervision, or
4545 completed a period of probation ordered by any court; or
4646 [(B) been pardoned or otherwise released from the
4747 resulting disability to vote]; and
4848 (5) be a resident of the county in which application
4949 for registration is made.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2021.
