| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 232.0085(a), Local Government Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) This section applies only to real property that | |
| 13 | 13 | [located]: | |
| 14 | 14 | (1) [outside municipalities and the extraterritorial | |
| 15 | 15 | jurisdiction of municipalities, as determined under Chapter 42; and | |
| 16 | 16 | [(2)] is located in the unincorporated area of an | |
| 17 | 17 | affected county, as defined by Section 16.341, Water Code, that: | |
| 18 | 18 | (A) has adopted the model rules developed under | |
| 19 | 19 | Section 16.343, Water Code;[,] and | |
| 20 | 20 | (B) is located along an international border; and | |
| 21 | 21 | (2) if the area is located in the extraterritorial | |
| 22 | 22 | jurisdiction of a municipality, is not subject to a written | |
| 23 | 23 | agreement under Section 242.001 that authorizes the municipality to | |
| 24 | 24 | regulate subdivision plats and approve related permits in the | |
| 25 | 25 | extraterritorial jurisdiction. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2021. |
