| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 154.051, Occupations Code, is amended as |
|---|
| 9 | 11 | | follows by amending Subsection (d) and adding Subsection (d-1): |
|---|
| 10 | 12 | | (d) The board may not consider or act on a complaint |
|---|
| 11 | 13 | | involving care provided more than seven years before the date on |
|---|
| 12 | 14 | | which the complaint is received by the board unless the care was |
|---|
| 13 | 15 | | provided to a minor or the care involves a complaint under |
|---|
| 14 | 16 | | Subsection (d-1). If the care was provided to a minor, the board |
|---|
| 15 | 17 | | may not consider or act on a complaint involving the care after the |
|---|
| 16 | 18 | | later of: |
|---|
| 17 | 19 | | (1) the date the minor is 21 years of age; or |
|---|
| 18 | 20 | | (2) the seventh anniversary of the date of the care. |
|---|
| 19 | 21 | | (d-1) The board may not consider or act on a complaint |
|---|
| 20 | 22 | | involving an alleged violation of Section 22.011(b)(12), Penal |
|---|
| 21 | 23 | | Code, that occurred more than seven years before the date on which |
|---|
| 22 | 24 | | the complaint is received by the board or more than 2 years from the |
|---|
| 23 | 25 | | date the complainant knew or should have known of the facts giving |
|---|
| 24 | 26 | | rise to the complaint, whichever is later. |
|---|
| 25 | 27 | | SECTION 2. The changes in law made by this Act apply to a |
|---|
| 26 | 28 | | complaint under Chapter 154, Occupations Code, initiated on or |
|---|
| 27 | 29 | | after the effective date of this Act. |
|---|
| 28 | 30 | | SECTION 3. This Act takes effect September 1, 2021. |
