46 AN ACT
57 relating to a Texas Medical Board complaint for a violation
68 described by Section 22.011(b)(12), Penal Code.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 154.051, Occupations Code, is amended as
911 follows by amending Subsection (d) and adding Subsection (d-1):
1012 (d) The board may not consider or act on a complaint
1113 involving care provided more than seven years before the date on
1214 which the complaint is received by the board unless the care was
1315 provided to a minor or the care involves a complaint under
1416 Subsection (d-1). If the care was provided to a minor, the board
1517 may not consider or act on a complaint involving the care after the
1618 later of:
1719 (1) the date the minor is 21 years of age; or
1820 (2) the seventh anniversary of the date of the care.
1921 (d-1) The board may not consider or act on a complaint
2022 involving an alleged violation of Section 22.011(b)(12), Penal
2123 Code, that occurred more than seven years before the date on which
2224 the complaint is received by the board or more than 2 years from the
2325 date the complainant knew or should have known of the facts giving
2426 rise to the complaint, whichever is later.
2527 SECTION 2. The changes in law made by this Act apply to a
2628 complaint under Chapter 154, Occupations Code, initiated on or
2729 after the effective date of this Act.
2830 SECTION 3. This Act takes effect September 1, 2021.
