| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter G, Chapter 501, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 508.1385 to read as follows: |
|---|
| 12 | 12 | | Sec. 508.1385. OPTIONAL COUNTY FEE. (a) Subject to |
|---|
| 13 | 13 | | Subsection (b), the commissioners court of a county by order may |
|---|
| 14 | 14 | | impose an additional fee, not to exceed $5, for an application for a |
|---|
| 15 | 15 | | title that is submitted to the county assessor-collector of that |
|---|
| 16 | 16 | | county. |
|---|
| 17 | 17 | | (b) A commissioners court of a county may impose the |
|---|
| 18 | 18 | | additional fee only if the fee is approved by a majority of the |
|---|
| 19 | 19 | | qualified voters of the county voting on the issue at a referendum |
|---|
| 20 | 20 | | election, which the commissioners court may order and hold for that |
|---|
| 21 | 21 | | purpose. |
|---|
| 22 | 22 | | (c) The additional fee shall be collected at the time an |
|---|
| 23 | 23 | | applicant applies for a title. The county treasurer shall deposit |
|---|
| 24 | 24 | | the additional fee in the officers' salary fund. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2021. |
