66 AN ACT
77 relating to authorizing an optional county fee imposed on an
88 applicant for a motor vehicle certificate of title.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter G, Chapter 501, Transportation Code,
1111 is amended by adding Section 508.1385 to read as follows:
1212 Sec. 508.1385. OPTIONAL COUNTY FEE. (a) Subject to
1313 Subsection (b), the commissioners court of a county by order may
1414 impose an additional fee, not to exceed $5, for an application for a
1515 title that is submitted to the county assessor-collector of that
1616 county.
1717 (b) A commissioners court of a county may impose the
1818 additional fee only if the fee is approved by a majority of the
1919 qualified voters of the county voting on the issue at a referendum
2020 election, which the commissioners court may order and hold for that
2121 purpose.
2222 (c) The additional fee shall be collected at the time an
2323 applicant applies for a title. The county treasurer shall deposit
2424 the additional fee in the officers' salary fund.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2021.
