7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. DEFINITIONS. In this Act: |
---|
9 | 11 | | (1) "Department" means the Texas Department of |
---|
10 | 12 | | Transportation. |
---|
11 | 13 | | (2) "Institute" means the Texas A&M Transportation |
---|
12 | 14 | | Institute. |
---|
13 | 15 | | (3) "Port of entry" has the meaning assigned by |
---|
14 | 16 | | Section 201.710, Transportation Code. |
---|
15 | 17 | | SECTION 2. FEASIBILITY STUDY ON COLOCATED INSPECTION PORTS. |
---|
16 | 18 | | (a) The institute, in consultation with the department and the |
---|
17 | 19 | | Department of Public Safety, shall conduct a feasibility study on |
---|
18 | 20 | | erecting and maintaining a colocated federal and state inspection |
---|
19 | 21 | | facility at each port of entry in this state for the inspection of |
---|
20 | 22 | | motor vehicles for compliance with federal and state commercial |
---|
21 | 23 | | motor vehicle regulations. The study must include: |
---|
22 | 24 | | (1) a summary of: |
---|
23 | 25 | | (A) past efforts by the Department of Public |
---|
24 | 26 | | Safety and the Federal Motor Carrier Safety Administration to |
---|
25 | 27 | | maintain colocated federal and state inspection facilities at each |
---|
26 | 28 | | port of entry; |
---|
27 | 29 | | (B) any current efforts to colocate or separate |
---|
28 | 30 | | federal and state inspection facilities at ports of entry in other |
---|
29 | 31 | | states; |
---|
30 | 32 | | (C) current wait times at inspection facilities |
---|
31 | 33 | | at each port of entry; |
---|
32 | 34 | | (D) current priorities and expectations of the |
---|
33 | 35 | | department and the Department of Public Safety regarding motor |
---|
34 | 36 | | vehicle inspections at ports of entry; |
---|
35 | 37 | | (E) the department's and Department of Public |
---|
36 | 38 | | Safety's perspectives on the advantages and disadvantages of |
---|
37 | 39 | | colocated federal and state inspection facilities; and |
---|
38 | 40 | | (F) the Federal Motor Carrier Safety |
---|
39 | 41 | | Administration's perspective on the advantages and disadvantages |
---|
40 | 42 | | of colocated federal and state inspection facilities, as solicited |
---|
41 | 43 | | by the institute under Subsection (b) of this section; |
---|
42 | 44 | | (2) potential scenarios for the colocation of federal |
---|
43 | 45 | | and state inspection facilities at each port of entry in this state |
---|
44 | 46 | | and an analysis of each scenario's advantages and disadvantages; |
---|
45 | 47 | | (3) an analysis of potential economic benefits of |
---|
46 | 48 | | colocating federal and state inspection facilities at each port of |
---|
47 | 49 | | entry; and |
---|
48 | 50 | | (4) an analysis of the potential effects of colocating |
---|
49 | 51 | | federal and state inspection facilities at each point of entry on |
---|
50 | 52 | | wait times at inspection facilities. |
---|
51 | 53 | | (b) In conducting the study under this section, the |
---|
52 | 54 | | institute shall solicit the Federal Motor Carrier Safety |
---|
53 | 55 | | Administration's perspective on the advantages and disadvantages |
---|
54 | 56 | | of colocated federal and state inspection facilities. |
---|
55 | 57 | | SECTION 3. REPORT. (a) Before the study under Section 2 of |
---|
56 | 58 | | this Act is completed, the institute shall contact the Federal |
---|
57 | 59 | | Motor Carrier Safety Administration to arrange receipt of the |
---|
58 | 60 | | report required by this subsection. Not later than December 1, |
---|
59 | 61 | | 2022, the institute shall report the results of the study conducted |
---|
60 | 62 | | under Section 2 of this Act and any recommendations to the Federal |
---|
61 | 63 | | Motor Carrier Safety Administration in the manner and format |
---|
62 | 64 | | requested by the Federal Motor Carrier Safety Administration. |
---|
63 | 65 | | (b) Not later than December 1, 2022, the institute shall |
---|
64 | 66 | | submit to the members of the legislature a report on the results of |
---|
65 | 67 | | the study conducted under Section 2 of this Act and any |
---|
66 | 68 | | recommendations for legislative or other action. |
---|
67 | 69 | | SECTION 4. EXPIRATION DATE. This Act expires January 1, |
---|
68 | 70 | | 2023. |
---|
69 | 71 | | SECTION 5. IMPLEMENTATION. The Texas A&M Transportation |
---|
70 | 72 | | Institute is required to implement this Act only if the legislature |
---|
71 | 73 | | appropriates money specifically for that purpose. If the |
---|
72 | 74 | | legislature does not appropriate money specifically for that |
---|
73 | 75 | | purpose, the Texas A&M Transportation Institute may, but is not |
---|
74 | 76 | | required to, implement this Act using other appropriations |
---|
75 | 77 | | available for the purpose. |
---|
76 | 78 | | SECTION 6. EFFECTIVE DATE. This Act takes effect September |
---|
77 | 79 | | 1, 2021. |
