55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the licensing of certain military veterans as health
88 care providers to practice in underserved areas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 155, Occupations Code, is
1111 amended by adding Section 155.108 to read as follows:
1212 Sec. 155.108. LICENSE FOR MILITARY VETERAN TO PRACTICE IN
1313 CERTAIN AREAS. (a) In this section, "active duty" and "armed
1414 forces of the United States" have the meanings assigned by Section
1515 55.001.
1616 (b) The board shall issue a license to practice medicine in
1717 a location described by Subsection (e) to an applicant who:
1818 (1) is licensed in good standing as a physician in
1919 another state;
2020 (2) is a veteran of the armed forces of the United
2121 States who retired from or otherwise left military service not more
2222 than one year before the application date for a license under this
2323 section; and
2424 (3) was, at the time of retiring from or leaving
2525 military service:
2626 (A) serving on active duty in this state; and
2727 (B) authorized as a physician to treat persons
2828 enlisted in the armed forces of the United States or veterans.
2929 (c) An applicant for a license under this section is not
3030 required to have passed the Texas medical jurisprudence
3131 examination.
3232 (d) The board may not issue a license under this section to
3333 an applicant who:
3434 (1) holds a medical license or a license to prescribe,
3535 dispense, administer, supply, or sell a controlled substance that:
3636 (A) is currently under active investigation; or
3737 (B) is or was subject to a disciplinary order or
3838 action or to denial by another jurisdiction; or
3939 (2) has been convicted of, is on deferred adjudication
4040 community supervision or deferred disposition for, or is under
4141 active investigation for the commission of:
4242 (A) a felony; or
4343 (B) a misdemeanor involving moral turpitude.
4444 (e) A physician licensed under this section may practice
4545 only in:
4646 (1) a health professional shortage area, as defined by
4747 Section 157.051; or
4848 (2) a medically underserved community, as defined by
4949 Section 487.201, Government Code.
5050 SECTION 2. Subchapter F, Chapter 301, Occupations Code, is
5151 amended by adding Section 301.262 to read as follows:
5252 Sec. 301.262. LICENSE FOR MILITARY VETERAN TO PRACTICE IN
5353 CERTAIN AREAS. (a) In this section, "active duty" and "armed
5454 forces of the United States" have the meanings assigned by Section
5555 55.001.
5656 (b) The board shall issue a license to practice nursing in a
5757 location described by Subsection (e) to an applicant who:
5858 (1) is licensed in good standing as a nurse in another
5959 state;
6060 (2) is a veteran of the armed forces of the United
6161 States who retired from or otherwise left military service not more
6262 than one year before the application date for a license under this
6363 section; and
6464 (3) was, at the time of retiring from or otherwise
6565 leaving military service:
6666 (A) serving on active duty in this state; and
6767 (B) authorized as a nurse to treat persons
6868 enlisted in the armed forces of the United States or veterans.
6969 (c) An applicant for a license under this section is not
7070 required to have passed the jurisprudence examination.
7171 (d) The board may not issue a license under this section to
7272 an applicant who:
7373 (1) holds a nursing license or a license to prescribe,
7474 dispense, administer, supply, or sell a controlled substance that:
7575 (A) is currently under active investigation; or
7676 (B) is or was subject to a disciplinary order or
7777 action or to denial by another jurisdiction; or
7878 (2) has been convicted of, is on deferred adjudication
7979 community supervision or deferred disposition for, or is under
8080 active investigation for the commission of:
8181 (A) a felony; or
8282 (B) a misdemeanor involving moral turpitude.
8383 (e) A nurse licensed under this section may practice only
8484 in:
8585 (1) a health professional shortage area, as defined by
8686 Section 157.051; or
8787 (2) a medically underserved community, as defined by
8888 Section 487.201, Government Code.
8989 SECTION 3. This Act takes effect September 1, 2021.
