66 AN ACT
77 relating to the provision of recovery community organization
88 peer-to-peer services under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.09991 to read as follows:
1212 Sec. 531.09991. RECOVERY COMMUNITY ORGANIZATIONS. (a) In
1313 this section, "recovery community organization" means a nonprofit
1414 organization that:
1515 (1) mobilizes resources inside and outside of a local
1616 community to increase the prevalence and quality of long-term
1717 recovery for individuals with a substance use disorder and their
1818 family members; and
1919 (2) is at least partly governed by individuals
2020 recovering from a substance use disorder or their family members.
2121 (b) The executive commissioner, with input from the work
2222 group established under Subsection (c), shall adopt rules to
2323 provide Medicaid reimbursement for peer-to-peer services provided
2424 by recovery community organizations, which must include:
2525 (1) rules that establish training requirements for
2626 recovery community organization peer-to-peer service providers;
2727 (2) rules that establish certification and
2828 supervision requirements for recovery community organizations;
2929 (3) rules that define the scope of peer-to-peer
3030 services that recovery community organizations may provide;
3131 (4) rules that distinguish peer-to-peer services
3232 provided by recovery community organizations from other services
3333 that a person must hold a license to provide; and
3434 (5) any other rules necessary to protect the health
3535 and safety of individuals receiving services provided by recovery
3636 community organizations.
3737 (c) The executive commissioner shall establish a work group
3838 to provide input for the adoption of rules under Subsection (b).
3939 The work group is composed of at least 9 but not more than 13 members
4040 with expertise in substance use disorder recovery or recovery
4141 community organizations. The executive commissioner shall ensure
4242 that at least half of the work group members are from rural
4343 communities in this state.
4444 (d) The executive commissioner shall appoint one work group
4545 member to serve as presiding officer.
4646 (e) The work group is automatically abolished on the
4747 adoption of rules under Subsection (b).
4848 (f) Subsections (c), (d), and (e) and this subsection expire
4949 September 1, 2023.
5050 SECTION 2. Effective January 1, 2023, Section 32.024, Human
5151 Resources Code, is amended by adding Subsection (pp) to read as
5252 follows:
5353 (pp) The commission in its rules and standards governing the
5454 scope of services provided under the medical assistance program
5555 shall include peer-to-peer services provided by recovery community
5656 organizations as defined by Section 531.09991, Government Code, to
5757 the extent permitted by federal law.
5858 SECTION 3. Not later than December 31, 2021, the executive
5959 commissioner of the Health and Human Services Commission shall
6060 establish the work group required by Section 531.09991, Government
6161 Code, as added by this Act.
6262 SECTION 4. Not later than December 31, 2022, the executive
6363 commissioner of the Health and Human Services Commission shall
6464 adopt the rules required by Section 531.09991, Government Code, as
6565 added by this Act.
6666 SECTION 5. If before implementing any provision of this Act
6767 a state agency determines that a waiver or authorization from a
6868 federal agency is necessary for implementation of that provision,
6969 the agency affected by the provision shall request the waiver or
7070 authorization and may delay implementing that provision until the
7171 waiver or authorization is granted.
7272 SECTION 6. Except as otherwise provided by this Act, this
7373 Act takes effect September 1, 2021.
