137 relating to restrictions on municipal regulation in certain areas.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Subchapter Z, Chapter 42, Local Government Code,
1610 is amended by adding section 42.905 to read as follows:
17- Sec. 42.905. RESTRICTION ON MUNICIPAL REGULATION IN CERTAIN
18- AREAS. (a) Notwithstanding other law, a municipality may not
19- regulate an activity or structure in an area in which the residents
20- are ineligible or have only limited eligibility to vote in
21- municipal elections.
22- (b) This section does not apply to municipal regulation of
23- an activity or structure under:
24- (1) Section 341.0359, 364.0341, or 713.009, Health and
25- Safety Code;
26- (2) Section 212.002, 212.003, 212.044, 215.003,
27- 215.072, 217.042, 242.001, 242.002, 242.003, 251.001, 273.001,
28- 331.001, 341.903, 372.003, 377.002, 380.001, 382.109, 386.002,
29- 395.011, 551.002, 551.004, 551.005, 551.006, 551.007, 552.001, or
30- 552.011 of this code;
31- (3) Section 61.015, Natural Resources Code;
32- (4) Section 351.0025, Tax Code;
33- (5) Section 26.177, Water Code; or
34- (6) Article 1524e, Revised Statutes.
11+ RESTRICTION ON MUNICIPAL REGULATION IN CERTAIN AREAS.
12+ Notwithstanding any other law, a municipality may not regulate an
13+ activity or structure in an area in which the residents are
14+ ineligible or have only limited eligibility to vote in municipal
15+ elections, except that a municipality has authority to regulate
16+ activities and structures in such area under the following
17+ provisions:
18+ (a) Section 364.0341, Health and Safety Code;
19+ (b) Section 713.009, Health and Safety Code;
20+ (c) Section 212.002, Local Government Code;
21+ (d) Section 212.003, Local Government Code;
22+ (e) Section 215.003, Local Government Code;
23+ (f) Section 217.042, Local Government Code;
24+ (g) Section 251.001, Local Government Code;
25+ (h) Section 331.001, Local Government Code;
26+ (i) Section 341.903, Local Government Code;
27+ (j) Section 372.003, Local Government Code;
28+ (k) Section 377.002, Local Government Code;
29+ (l) Section 380.001, Local Government Code;
30+ (m) Section 382.109, Local Government Code;
31+ (n) Section 395.011, Local Government Code;
32+ (o) Section 551.002, Local Government Code;
33+ (p) Section 552.001, Local Government Code;
34+ (q) Section 351.0025, Tax Code; and
35+ (r) Section 26.177, Water Code.
3536 SECTION 2. This Act takes effect September 1, 2021.
