| 7 | 7 | | relating to an audit by the Texas Education Agency of public school |

| 8 | 8 | | professional development training requirements. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Sections 21.4513(a) and (b), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) Using only available funds and resources from public or |
|---|
| 13 | 13 | | private sources, the agency shall [periodically] conduct an audit |
|---|
| 14 | 14 | | at least once every four years of the professional development |
|---|
| 15 | 15 | | requirements applicable to educators in this state and any other |
|---|
| 16 | 16 | | continuing education and training requirements, including state |
|---|
| 17 | 17 | | and federal requirements and requirements imposed by school |
|---|
| 18 | 18 | | districts. |
|---|
| 19 | 19 | | (b) Based on audit results, the agency, with input from |
|---|
| 20 | 20 | | stakeholders and organizations that represent educators, shall |
|---|
| 21 | 21 | | consider the value of maintaining existing state-mandated training |
|---|
| 22 | 22 | | requirements relating to specific topics and seek to eliminate any |
|---|
| 23 | 23 | | unnecessary topic-specific training requirements, eliminate any |
|---|
| 24 | 24 | | conflicting requirements, and consolidate any duplicative |
|---|
| 25 | 25 | | requirements through the following methods, as appropriate: |
|---|
| 26 | 26 | | (1) taking administrative action; |
|---|
| 27 | 27 | | (2) encouraging school districts to make appropriate |
|---|
| 28 | 28 | | changes to district policies; or |
|---|
| 29 | 29 | | (3) recommending statutory changes to the |
|---|
| 30 | 30 | | legislature. |
|---|
| 31 | 31 | | SECTION 2. Not later than December 31, 2022, the Texas |
|---|
| 32 | 32 | | Education Agency shall complete an audit of professional |
|---|
| 33 | 33 | | development training requirements as required by Section 21.4513, |
|---|
| 34 | 34 | | Education Code, as amended by this Act. |
|---|
| 35 | 35 | | SECTION 3. The Texas Education Agency is required to |
|---|
| 36 | 36 | | implement a provision of this Act only if the legislature |
|---|
| 37 | 37 | | appropriates money specifically for that purpose. If the |
|---|
| 38 | 38 | | legislature does not appropriate money specifically for that |
|---|
| 39 | 39 | | purpose, the Texas Education Agency may, but is not required to, |
|---|
| 40 | 40 | | implement a provision of this Act using other appropriations |
|---|
| 41 | 41 | | available for that purpose. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2021. |
