55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an audit by the Texas Education Agency of public school
88 professional development training requirements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 21.4513(a) and (b), Education Code, are
1111 amended to read as follows:
1212 (a) Using only available funds and resources from public or
1313 private sources, the agency shall [periodically] conduct an audit
1414 at least once every four years of the professional development
1515 requirements applicable to educators in this state and any other
1616 continuing education and training requirements, including state
1717 and federal requirements and requirements imposed by school
1818 districts.
1919 (b) Based on audit results, the agency, with input from
2020 stakeholders and organizations that represent educators, shall
2121 consider the value of maintaining existing state-mandated training
2222 requirements relating to specific topics and seek to eliminate any
2323 unnecessary topic-specific training requirements, eliminate any
2424 conflicting requirements, and consolidate any duplicative
2525 requirements through the following methods, as appropriate:
2626 (1) taking administrative action;
2727 (2) encouraging school districts to make appropriate
2828 changes to district policies; or
2929 (3) recommending statutory changes to the
3030 legislature.
3131 SECTION 2. Not later than December 31, 2022, the Texas
3232 Education Agency shall complete an audit of professional
3333 development training requirements as required by Section 21.4513,
3434 Education Code, as amended by this Act.
3535 SECTION 3. The Texas Education Agency is required to
3636 implement a provision of this Act only if the legislature
3737 appropriates money specifically for that purpose. If the
3838 legislature does not appropriate money specifically for that
3939 purpose, the Texas Education Agency may, but is not required to,
4040 implement a provision of this Act using other appropriations
4141 available for that purpose.
4242 SECTION 4. This Act takes effect September 1, 2021.
