66 AN ACT
77 relating to prohibiting consideration of certain factors in student
88 admissions to public institutions of higher education in this
99 state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1212 amended by adding Section 51.9243 to read as follows:
1313 Sec. 51.9243. PROHIBITION ON LEGACY PREFERENCES AND OTHER
1414 CONSIDERATIONS IN ADMISSIONS. An institution of higher education
1515 may not discriminate against, or give preferential treatment to, an
1616 applicant for admission to the institution or to any college or
1717 other educational program of the institution on the basis of:
1818 (1) a donation made or promised to the institution by
1919 any person; or
2020 (2) whether any relative or family member of the
2121 applicant previously attended or supported the institution in any
2222 manner.
2323 SECTION 2. Section 51.805(c), Education Code, is amended to
2424 read as follows:
2525 (c) A general academic teaching institution may review
2626 other factors in making an admissions decision, subject to Section
2727 51.9243.
2828 SECTION 3. This Act takes effect September 1, 2021.
