| 11 | 11 | SECTION 1. Subchapter Z, Chapter 51, Education Code, is | |
| 12 | 12 | amended by adding Section 51.9243 to read as follows: | |
| 13 | 13 | Sec. 51.9243. PROHIBITION ON LEGACY PREFERENCES AND OTHER | |
| 14 | 14 | CONSIDERATIONS IN ADMISSIONS. An institution of higher education | |
| 15 | 15 | may not discriminate against, or give preferential treatment to, an | |
| 16 | 16 | applicant for admission to the institution or to any college or | |
| 17 | 17 | other educational program of the institution on the basis of: | |
| 18 | 18 | (1) a donation made or promised to the institution by | |
| 19 | 19 | any person; or | |
| 20 | 20 | (2) whether any relative or family member of the | |
| 21 | 21 | applicant previously attended or supported the institution in any | |
| 22 | 22 | manner. | |
| 23 | 23 | SECTION 2. Section 51.805(c), Education Code, is amended to | |
| 24 | 24 | read as follows: | |
| 25 | 25 | (c) A general academic teaching institution may review | |
| 26 | 26 | other factors in making an admissions decision, subject to Section | |
| 27 | 27 | 51.9243. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
