| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 303.021, Local Government Code, is |
|---|
| 9 | 11 | | amended by adding Subsection (c) to read as follows: |
|---|
| 10 | 12 | | (c) A corporation created under this chapter must remain a |
|---|
| 11 | 13 | | public facility corporation under this chapter. |
|---|
| 12 | 14 | | SECTION 2. Section 303.022, Local Government Code, is |
|---|
| 13 | 15 | | amended to read as follows: |
|---|
| 14 | 16 | | Sec. 303.022. CREATION UNDER OTHER LAW. A nonprofit |
|---|
| 15 | 17 | | corporation created by a housing authority under the Texas |
|---|
| 16 | 18 | | Non-Profit Corporation Act (Article 1396-1.01 et seq., Vernon's |
|---|
| 17 | 19 | | Texas Civil Statutes), regardless of the date the corporation is |
|---|
| 18 | 20 | | created, is considered a corporation under this chapter, [and] has |
|---|
| 19 | 21 | | the rights and powers necessary or convenient to accomplish a |
|---|
| 20 | 22 | | corporation's purposes under this chapter, and is subject to the |
|---|
| 21 | 23 | | requirements of this chapter. |

| 22 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 23 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 28 | | Act takes effect September 1, 2021. |
