55 AN ACT
66 relating the delivery of alcoholic beverages from certain premises
77 to ultimate consumers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 22.03, Subtitle A, Title 3, Alcoholic
1010 Beverage Code, is amended to read as follows:
1111 Sec. 22.03. DELIVERIES TO CUSTOMERS. (a) The holder of a
1212 package store permit or wine only package store permit [issued for a
1313 location within a city or town or within two miles of the corporate
1414 limits of a city or town] may make deliveries of and collections for
1515 alcoholic beverages off the premises [in areas where the sale of the
1616 beverages is legal]. The permittee must [travel by the most direct
1717 route and may] make deliveries and collections [only within the
1818 county or the city or town or within two miles of its corporate
1919 limits, and] only in response to bona fide orders placed by the
2020 customer, either in person at the premises, in writing, by mail,
2121 [or] by telegraph, [or] by telephone or other electronic means.
2222 This section shall not be construed as preventing a holder of a
2323 package store permit or wine only package store permit from
2424 delivering alcoholic beverages to the holder of a carrier's permit
2525 for transportation to persons who have placed bona fide orders and
2626 who are located in an area that the holder of a package store permit
2727 or wine only package store permit is authorized to directly deliver
2828 to under this section. The holder of a package store permit or wine
2929 only package store permit may also deliver alcoholic beverages to
3030 the holder of a carrier's permit for transportation outside of this
3131 state in response to bona fide orders placed by persons authorized
3232 to purchase the beverages.
3333 (b) The holder of a package store permit may transport
3434 alcoholic beverages to a commercial airline in a regional airport
3535 located all or partly in an adjoining county if the airport is
3636 governed by a board, commission, or authority, some of whose
3737 members reside in the county where the package store is located.
3838 SECTION 2. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2021.
