| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 22.03, Subtitle A, Title 3, Alcoholic |
|---|
| 10 | 10 | | Beverage Code, is amended to read as follows: |
|---|
| 11 | 11 | | Sec. 22.03. DELIVERIES TO CUSTOMERS. (a) The holder of a |
|---|
| 12 | 12 | | package store permit or wine only package store permit [issued for a |
|---|
| 13 | 13 | | location within a city or town or within two miles of the corporate |
|---|
| 14 | 14 | | limits of a city or town] may make deliveries of and collections for |
|---|
| 15 | 15 | | alcoholic beverages off the premises [in areas where the sale of the |
|---|
| 16 | 16 | | beverages is legal]. The permittee must [travel by the most direct |
|---|
| 17 | 17 | | route and may] make deliveries and collections [only within the |
|---|
| 18 | 18 | | county or the city or town or within two miles of its corporate |
|---|
| 19 | 19 | | limits, and] only in response to bona fide orders placed by the |
|---|
| 20 | 20 | | customer, either in person at the premises, in writing, by mail, |
|---|
| 21 | 21 | | [or] by telegraph, [or] by telephone or other electronic means. |
|---|
| 22 | 22 | | This section shall not be construed as preventing a holder of a |
|---|
| 23 | 23 | | package store permit or wine only package store permit from |
|---|
| 24 | 24 | | delivering alcoholic beverages to the holder of a carrier's permit |
|---|
| 25 | 25 | | for transportation to persons who have placed bona fide orders and |
|---|
| 26 | 26 | | who are located in an area that the holder of a package store permit |
|---|
| 27 | 27 | | or wine only package store permit is authorized to directly deliver |
|---|
| 28 | 28 | | to under this section. The holder of a package store permit or wine |
|---|
| 29 | 29 | | only package store permit may also deliver alcoholic beverages to |
|---|
| 30 | 30 | | the holder of a carrier's permit for transportation outside of this |
|---|
| 31 | 31 | | state in response to bona fide orders placed by persons authorized |
|---|
| 32 | 32 | | to purchase the beverages. |
|---|
| 33 | 33 | | (b) The holder of a package store permit may transport |
|---|
| 34 | 34 | | alcoholic beverages to a commercial airline in a regional airport |
|---|
| 35 | 35 | | located all or partly in an adjoining county if the airport is |
|---|
| 36 | 36 | | governed by a board, commission, or authority, some of whose |
|---|
| 37 | 37 | | members reside in the county where the package store is located. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2021. |
