| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 7811.052, Special District Local Laws |
|---|
| 9 | 11 | | Code, is amended to read as follows: |
|---|
| 10 | 12 | | Sec. 7811.052. QUALIFICATIONS AND ELIGIBILITY FOR OFFICE. |
|---|
| 11 | 13 | | (a) To be qualified to serve as a director, a person must be at |
|---|
| 12 | 14 | | least 18 years of age and: |
|---|
| 13 | 15 | | (1) an owner of taxable property in the district; |
|---|
| 14 | 16 | | (2) an owner of stock, whether beneficial or |
|---|
| 15 | 17 | | otherwise, of a corporate owner of property in the district; |
|---|
| 16 | 18 | | (3) an owner of a beneficial interest in a trust that |
|---|
| 17 | 19 | | owns property in the district; or |
|---|
| 18 | 20 | | (4) an agent, employee, or tenant of a person covered |
|---|
| 19 | 21 | | by Subdivision (1), (2), or (3). |
|---|
| 20 | 22 | | (b) A director must meet the qualifications described by |
|---|
| 21 | 23 | | Subsection (a) [own land in the district subject to taxation] at the |
|---|
| 22 | 24 | | time the director qualifies for office. |
|---|
| 23 | 25 | | SECTION 2. (a) The legal notice of the intention to |
|---|
| 24 | 26 | | introduce this Act, setting forth the general substance of this |
|---|
| 25 | 27 | | Act, has been published as provided by law, and the notice and a |
|---|
| 26 | 28 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 27 | 29 | | officials, or entities to which they are required to be furnished |
|---|
| 28 | 30 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 29 | 31 | | Government Code. |
|---|
| 30 | 32 | | (b) The governor, one of the required recipients, has |
|---|
| 31 | 33 | | submitted the notice and Act to the Texas Commission on |
|---|
| 32 | 34 | | Environmental Quality. |
|---|
| 33 | 35 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 34 | 36 | | its recommendations relating to this Act with the governor, the |
|---|
| 35 | 37 | | lieutenant governor, and the speaker of the house of |
|---|
| 36 | 38 | | representatives within the required time. |
|---|
| 37 | 39 | | (d) All requirements of the constitution and laws of this |
|---|
| 38 | 40 | | state and the rules and procedures of the legislature with respect |
|---|
| 39 | 41 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 40 | 42 | | and accomplished. |
|---|
| 41 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 47 | | Act takes effect September 1, 2021. |
