57 relating to qualifications for the directors of the Dallas County
68 Flood Control District No. 1.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 7811.052, Special District Local Laws
911 Code, is amended to read as follows:
1012 Sec. 7811.052. QUALIFICATIONS AND ELIGIBILITY FOR OFFICE.
1113 (a) To be qualified to serve as a director, a person must be at
1214 least 18 years of age and:
1315 (1) an owner of taxable property in the district;
1416 (2) an owner of stock, whether beneficial or
1517 otherwise, of a corporate owner of property in the district;
1618 (3) an owner of a beneficial interest in a trust that
1719 owns property in the district; or
1820 (4) an agent, employee, or tenant of a person covered
1921 by Subdivision (1), (2), or (3).
2022 (b) A director must meet the qualifications described by
2123 Subsection (a) [own land in the district subject to taxation] at the
2224 time the director qualifies for office.
2325 SECTION 2. (a) The legal notice of the intention to
2426 introduce this Act, setting forth the general substance of this
2527 Act, has been published as provided by law, and the notice and a
2628 copy of this Act have been furnished to all persons, agencies,
2729 officials, or entities to which they are required to be furnished
2830 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
2931 Government Code.
3032 (b) The governor, one of the required recipients, has
3133 submitted the notice and Act to the Texas Commission on
3234 Environmental Quality.
3335 (c) The Texas Commission on Environmental Quality has filed
3436 its recommendations relating to this Act with the governor, the
3537 lieutenant governor, and the speaker of the house of
3638 representatives within the required time.
3739 (d) All requirements of the constitution and laws of this
3840 state and the rules and procedures of the legislature with respect
3941 to the notice, introduction, and passage of this Act are fulfilled
4042 and accomplished.
4143 SECTION 3. This Act takes effect immediately if it receives
4244 a vote of two-thirds of all the members elected to each house, as
4345 provided by Section 39, Article III, Texas Constitution. If this
4446 Act does not receive the vote necessary for immediate effect, this
4547 Act takes effect September 1, 2021.
