| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 8316.103, Special District Local Laws |
|---|
| 10 | 10 | | Code, is amended to read as follows: |
|---|
| 11 | 11 | | Sec. 8316.103. AUTHORITY FOR ROAD PROJECTS. Under Section |
|---|
| 12 | 12 | | 52, Article III, Texas Constitution, the district may design, |
|---|
| 13 | 13 | | acquire, construct, finance, issue bonds for, improve, operate, |
|---|
| 14 | 14 | | maintain, and convey to this state, a county, or a municipality for |
|---|
| 15 | 15 | | operation and maintenance macadamized, graveled, or paved roads, or |
|---|
| 16 | 16 | | improvements, including storm drainage, in aid of those roads, |
|---|
| 17 | 17 | | including roads within a gated community as defined by Section |
|---|
| 18 | 18 | | 352.112, Local Government Code, provided that those roads are open |
|---|
| 19 | 19 | | and accessible to all owners of real property located in the |
|---|
| 20 | 20 | | district, all residents of the district, and the invitees of owners |
|---|
| 21 | 21 | | and residents of the district. |

| 22 | 22 | | SECTION 2. The Blaketree Municipal Utility District No. 1 of |
|---|
| 23 | 23 | | Montgomery County retains all the rights, powers, privileges, |
|---|
| 24 | 24 | | authority, duties, and functions that it had before the effective |
|---|
| 25 | 25 | | date of this Act. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives a |
|---|
| 27 | 27 | | vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2021. |
