55 AN ACT
66 relating to the authority for road projects of the Blaketree
77 Municipal Utility District No. 1 of Montgomery County.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 8316.103, Special District Local Laws
1010 Code, is amended to read as follows:
1111 Sec. 8316.103. AUTHORITY FOR ROAD PROJECTS. Under Section
1212 52, Article III, Texas Constitution, the district may design,
1313 acquire, construct, finance, issue bonds for, improve, operate,
1414 maintain, and convey to this state, a county, or a municipality for
1515 operation and maintenance macadamized, graveled, or paved roads, or
1616 improvements, including storm drainage, in aid of those roads,
1717 including roads within a gated community as defined by Section
1818 352.112, Local Government Code, provided that those roads are open
1919 and accessible to all owners of real property located in the
2020 district, all residents of the district, and the invitees of owners
2121 and residents of the district.
2222 SECTION 2. The Blaketree Municipal Utility District No. 1 of
2323 Montgomery County retains all the rights, powers, privileges,
2424 authority, duties, and functions that it had before the effective
2525 date of this Act.
2626 SECTION 3. This Act takes effect immediately if it receives a
2727 vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2021.
