55 AN ACT
66 relating to reporting and disseminating information regarding
77 public school disciplinary actions.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Section 37.020, Education Code,
1010 is amended to read as follows:
1111 Sec. 37.020. REPORTS RELATING TO SUSPENSIONS, EXPULSIONS,
1212 AND DISCIPLINARY ALTERNATIVE EDUCATION PROGRAM PLACEMENTS.
1313 SECTION 2. Section 37.020, Education Code, is amended by
1414 adding Subsections (f) and (g) to read as follows:
1515 (f) For each suspension under Section 37.005, the district
1616 shall report:
1717 (1) information identifying the student, including
1818 the student's race, sex, and date of birth and whether the student
1919 is in a special education program under Subchapter A, Chapter 29, or
2020 covered by Section 504, Rehabilitation Act of 1973 (29 U.S.C.
2121 Section 794), that will enable the agency to compare placement data
2222 with information collected through other reports;
2323 (2) information indicating the basis for the
2424 suspension;
2525 (3) the number of full or partial days the student was
2626 suspended; and
2727 (4) the number of suspensions that were inconsistent
2828 with the guidelines included in the student code of conduct under
2929 Section 37.001(a)(3).
3030 (g) The agency shall make information collected under this
3131 section, disaggregated by race, sex, and age of the student and
3232 whether the student is in a special education program under
3333 Subchapter A, Chapter 29, or covered by Section 504, Rehabilitation
3434 Act of 1973 (29 U.S.C. Section 794), available to the public in a
3535 manner that does not identify an individual student. The agency
3636 shall also make the information available to the public in a manner
3737 showing all intersectional data for the categories described by
3838 this subsection.
3939 SECTION 3. This Act applies beginning with the 2019-2020
4040 school year.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2019.
