| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Section 37.020, Education Code, |
|---|
| 10 | 10 | | is amended to read as follows: |
|---|
| 11 | 11 | | Sec. 37.020. REPORTS RELATING TO SUSPENSIONS, EXPULSIONS, |
|---|
| 12 | 12 | | AND DISCIPLINARY ALTERNATIVE EDUCATION PROGRAM PLACEMENTS. |
|---|
| 13 | 13 | | SECTION 2. Section 37.020, Education Code, is amended by |
|---|
| 14 | 14 | | adding Subsections (f) and (g) to read as follows: |
|---|
| 15 | 15 | | (f) For each suspension under Section 37.005, the district |
|---|
| 16 | 16 | | shall report: |
|---|
| 17 | 17 | | (1) information identifying the student, including |
|---|
| 18 | 18 | | the student's race, sex, and date of birth and whether the student |
|---|
| 19 | 19 | | is in a special education program under Subchapter A, Chapter 29, or |
|---|
| 20 | 20 | | covered by Section 504, Rehabilitation Act of 1973 (29 U.S.C. |
|---|
| 21 | 21 | | Section 794), that will enable the agency to compare placement data |
|---|
| 22 | 22 | | with information collected through other reports; |
|---|
| 23 | 23 | | (2) information indicating the basis for the |
|---|
| 24 | 24 | | suspension; |
|---|
| 25 | 25 | | (3) the number of full or partial days the student was |
|---|
| 26 | 26 | | suspended; and |
|---|
| 27 | 27 | | (4) the number of suspensions that were inconsistent |
|---|
| 28 | 28 | | with the guidelines included in the student code of conduct under |
|---|
| 29 | 29 | | Section 37.001(a)(3). |
|---|
| 30 | 30 | | (g) The agency shall make information collected under this |
|---|
| 31 | 31 | | section, disaggregated by race, sex, and age of the student and |
|---|
| 32 | 32 | | whether the student is in a special education program under |
|---|
| 33 | 33 | | Subchapter A, Chapter 29, or covered by Section 504, Rehabilitation |
|---|
| 34 | 34 | | Act of 1973 (29 U.S.C. Section 794), available to the public in a |
|---|
| 35 | 35 | | manner that does not identify an individual student. The agency |
|---|
| 36 | 36 | | shall also make the information available to the public in a manner |
|---|
| 37 | 37 | | showing all intersectional data for the categories described by |
|---|
| 38 | 38 | | this subsection. |
|---|
| 39 | 39 | | SECTION 3. This Act applies beginning with the 2019-2020 |
|---|
| 40 | 40 | | school year. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2019. |
