55 AN ACT
66 relating to the carcinogenic risk level used in the development of
77 certain environmental remediation benchmarks.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 361, Health and Safety
1010 Code, is amended by adding Section 361.042 to read as follows:
1111 Sec. 361.042. MINIMUM CARCINOGENIC RISK LEVEL. (a) In
1212 this section, "carcinogenic risk level," "protective concentration
1313 level," and "risk-based exposure limit" have the meanings assigned
1414 by 30 T.A.C. Section 350.4, as that section existed on January 1,
1515 2019.
1616 (b) The commission shall set each carcinogenic risk level
1717 used by the commission in the development of a protective
1818 concentration level, risk-based exposure limit, or any other
1919 remediation standard used in connection with this chapter or a rule
2020 adopted under this chapter, including the Texas Risk Reduction
2121 Program (30 T.A.C. Chapter 350) or a similar program established by
2222 the commission, at a rate not greater than one in one million.
2323 SECTION 2. As soon as practicable after the effective date
2424 of this Act, the Texas Commission on Environmental Quality shall
2525 adopt or modify any rules necessary to implement the change in law
2626 made by this Act.
2727 SECTION 3. This Act takes effect September 1, 2021.
