55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to notifying an alleged perpetrator of child abuse or
88 neglect of the person's right to record an investigative interview.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 261, Family Code, is
1111 amended by adding Section 261.3027 to read as follows:
1212 Sec. 261.3027. NOTICE OF RIGHT TO RECORD INTERVIEW. (a)
1313 Before conducting an interview with an alleged perpetrator, the
1414 department shall inform the person that:
1515 (1) the person may record the interview; and
1616 (2) any recording made by the person may be subject to
1717 subpoena under a court order.
1818 (b) The department shall document in the case file that the
1919 department provided the notice required by Subsection (a).
2020 SECTION 2. This Act takes effect September 1, 2021.
