9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter D, Chapter 261, Family Code, is | |
11 | 11 | amended by adding Section 261.3027 to read as follows: | |
12 | 12 | Sec. 261.3027. NOTICE OF RIGHT TO RECORD INTERVIEW. (a) | |
13 | 13 | Before conducting an interview with an alleged perpetrator, the | |
14 | 14 | department shall inform the person that: | |
15 | 15 | (1) the person may record the interview; and | |
16 | 16 | (2) any recording made by the person may be subject to | |
17 | 17 | subpoena under a court order. | |
18 | 18 | (b) The department shall document in the case file that the | |
19 | 19 | department provided the notice required by Subsection (a). | |
20 | 20 | SECTION 2. This Act takes effect September 1, 2021. |
