7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 1701.302, Occupations Code, is amended | |
9 | 9 | by amending Subsection (a) and adding Subsection (a-1) to read as | |
10 | 10 | follows: | |
11 | 11 | (a) Except as provided by Subsection (a-1), an [An] officer, | |
12 | 12 | including a sheriff, elected under the Texas Constitution or a | |
13 | 13 | statute or appointed to fill a vacancy in an elective office must | |
14 | 14 | obtain a license from the commission not later than [the second | |
15 | 15 | anniversary of] the date the officer takes office. | |
16 | 16 | (a-1) An officer described in Subsection (a) must obtain a | |
17 | 17 | license from the commission not later than the second anniversary | |
18 | 18 | of the date the officer takes office if: | |
19 | 19 | (1) the officer serves a county with fewer than 50,000 | |
20 | 20 | people; or | |
21 | 21 | (2) the commissioner's court of the county served by | |
22 | 22 | the officer votes unanimously to waive the requirement of | |
23 | 23 | Subsection (a). | |
24 | 24 | SECTION 2. An officer subject to Subsection (a), Section | |
25 | 25 | 1701.302, Occupations Code, as amended by this Act, who holds | |
26 | 26 | office on the effective date of this Act must obtain a license from | |
27 | 27 | the Texas Commission on Law Enforcement by September 1, 2022. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
