44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to qualifications for sheriffs in certain counties.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1701.302, Occupations Code, is amended
99 by amending Subsection (a) and adding Subsection (a-1) to read as
1010 follows:
1111 (a) Except as provided by Subsection (a-1), an [An] officer,
1212 including a sheriff, elected under the Texas Constitution or a
1313 statute or appointed to fill a vacancy in an elective office must
1414 obtain a license from the commission not later than [the second
1515 anniversary of] the date the officer takes office.
1616 (a-1) An officer described in Subsection (a) must obtain a
1717 license from the commission not later than the second anniversary
1818 of the date the officer takes office if:
1919 (1) the officer serves a county with fewer than 50,000
2020 people; or
2121 (2) the commissioner's court of the county served by
2222 the officer votes unanimously to waive the requirement of
2323 Subsection (a).
2424 SECTION 2. An officer subject to Subsection (a), Section
2525 1701.302, Occupations Code, as amended by this Act, who holds
2626 office on the effective date of this Act must obtain a license from
2727 the Texas Commission on Law Enforcement by September 1, 2022.
2828 SECTION 3. This Act takes effect September 1, 2021.
