7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. Chapter 197, Acts of the 58th Legislature, |
---|
9 | 11 | | Regular Session, 1963, is amended by adding Section 1A to read as |
---|
10 | 12 | | follows: |
---|
11 | 13 | | Sec. 1A. (a) In this section, "special purpose area" means |
---|
12 | 14 | | the territory described by Subsection (e) of this section. |
---|
13 | 15 | | (b) Waterborne commercial cargo and vessel movements |
---|
14 | 16 | | originating in or departing from the special purpose area may be |
---|
15 | 17 | | attributed as waterborne commercial cargo or vessel movements |
---|
16 | 18 | | originating in or departing from the district for the purpose of |
---|
17 | 19 | | reporting to the United States Army Corps of Engineers under |
---|
18 | 20 | | applicable federal law. |
---|
19 | 21 | | (c) The inclusion in the district of the special purpose |
---|
20 | 22 | | area does not affect any powers or duties exercised in the special |
---|
21 | 23 | | purpose area by the Sabine-Neches Navigation District or the Port |
---|
22 | 24 | | of Beaumont Navigation District of Jefferson County, Texas. |
---|
23 | 25 | | (d) The district may not impose a tax in the special purpose |
---|
24 | 26 | | area. |
---|
25 | 27 | | (e) In addition to the territory described by Section 1 of |
---|
26 | 28 | | this Act, the Port of Port Arthur Navigation District of Jefferson |
---|
27 | 29 | | County, Texas, includes the following tract as a special purpose |
---|
28 | 30 | | area: |
---|
29 | 31 | | BEING 133.8 ± acres of land and water, part of the Neches |
---|
30 | 32 | | River in the City of Port Arthur, Jefferson County, Texas; said |
---|
31 | 33 | | 133.8 ± acre tract being more fully described by metes and bounds as |
---|
32 | 34 | | follows, to wit: |
---|
33 | 35 | | BEGINNING at a point on the intersection of the thread of the |
---|
34 | 36 | | Neches River with the current city limits of the City of Port |
---|
35 | 37 | | Arthur, as described in Annexation Ordinance No. 2540, for the most |
---|
36 | 38 | | northerly comer of the herein described tract; |
---|
37 | 39 | | THENCE, in a southeasterly direction, with the thread of the |
---|
38 | 40 | | Neches River, a distance of 7885'± to its intersection with the |
---|
39 | 41 | | current boundary of the Port of Port Arthur Navigation District on |
---|
40 | 42 | | the centerline of State Highway 87, for the most easterly comer of |
---|
41 | 43 | | the herein described tract; |
---|
42 | 44 | | THENCE, in a southwesterly direction, on the centerline of |
---|
43 | 45 | | State Highway 87, being the current boundary of the Port of Port |
---|
44 | 46 | | Arthur Navigation District, a distance of 690'± to a point on the |
---|
45 | 47 | | projected southwesterly bank of the Neches River, for the most |
---|
46 | 48 | | southerly comer of the herein described tract; |

47 | 49 | | THENCE, in a northwesterly direction, on the Southwest bank |
---|
48 | 50 | | of the Neches River, a distance of 9000'± to its intersection with |

49 | 51 | | the Northwest line of City of Port Arthur Annexation Ordinance |

50 | 52 | | No. 2540, same being the southeasterly line of a (Called 16.130) |

51 | 53 | | acre tract of land, known as Tract Five, Parcel SE, recorded in File |

52 | 54 | | No. 2020000404, Official Public Records, Jefferson County, Texas, |

53 | 55 | | for the most westerly comer of the herein described tract; |

54 | 56 | | THENCE, in a northeasterly direction, on the Northwest line |

55 | 57 | | of City of Port Arthur Annexation Ordinance No. 2540, a distance of |

56 | 58 | | 1045'± to the POINT OF BEGINNING, and containing 133.8 ± acres of |
---|
57 | 59 | | land, more or less. |

58 | 60 | | SECTION 2. (a) The legal notice of the intention to |
---|
59 | 61 | | introduce this Act, setting forth the general substance of this |
---|
60 | 62 | | Act, has been published as provided by law, and the notice and a |
---|
61 | 63 | | copy of this Act have been furnished to all persons, agencies, |
---|
62 | 64 | | officials, or entities to which they are required to be furnished |
---|
63 | 65 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
64 | 66 | | Government Code. |
---|
65 | 67 | | (b) The governor, one of the required recipients, has |
---|
66 | 68 | | submitted the notice and Act to the Texas Commission on |
---|
67 | 69 | | Environmental Quality. |
---|
68 | 70 | | (c) The Texas Commission on Environmental Quality has filed |
---|
69 | 71 | | its recommendations relating to this Act with the governor, the |
---|
70 | 72 | | lieutenant governor, and the speaker of the house of |
---|
71 | 73 | | representatives within the required time. |
---|
72 | 74 | | (d) All requirements of the constitution and laws of this |
---|
73 | 75 | | state and the rules and procedures of the legislature with respect |
---|
74 | 76 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
75 | 77 | | and accomplished. |
---|
76 | 78 | | SECTION 3. This Act takes effect immediately if it receives |
---|
77 | 79 | | a vote of two-thirds of all the members elected to each house, as |
---|
78 | 80 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
79 | 81 | | Act does not receive the vote necessary for immediate effect, this |
---|
80 | 82 | | Act takes effect September 1, 2021. |
