4	8		AN ACT
5	9		relating to the control of diseases of swine.
6	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	11		SECTION 1. Section 165.002, Agriculture Code, is amended to
8	12		read as follows:
9	13		Sec. 165.002. [OWNER] TREATMENT. Except as otherwise
10	14		provided by law, a representative of the commission or a person
11	15		authorized by the commission may vaccinate, inoculate, or treat
12	16		hogs [owned by that person] with classical swine fever [hog
13	17		cholera] virus or serum or with another remedy[, and a county
14	18		demonstration agent may vaccinate, inoculate, or treat any hogs in
15	19		the county in which the agent is employed with hog cholera virus or
16	20		serum or with another remedy].
17	21		SECTION 2. Section 165.003, Agriculture Code, is amended to
18	22		read as follows:
19	23		Sec. 165.003. SALE OR DISTRIBUTION OF UNATTENUATED
20	24		CLASSICAL SWINE FEVER [HOG CHOLERA] VIRUS. (a) A person may not
21	25		sell, offer for sale, barter, exchange, or give away unattenuated
22	26		classical swine fever [hog cholera] virus.
23	27		(b) This section does not prohibit:
24	28		(1) acquisition, propagation, manufacture, or use of
25	29		unattenuated classical swine fever [hog cholera] virus by, and on
26	30		the licensed premises of, a firm operating under a United States
27	31		veterinary license issued by the secretary of agriculture of the
28	32		United States;
29	33		(2) manufacture of unattenuated classical swine fever
30	34		[hog cholera] virus by a firm operating under a United States
31	35		veterinary license for the sale or distribution in states in which
32	36		use of attenuated classical swine fever [hog cholera] virus is
33	37		permitted; or
34	38		(3) keeping vaccine on hand for purely experimental or
35	39		research activities by a recognized college, university, school, or
36	40		laboratory engaged in research activities.
37	41		(c) In this section, "unattenuated classical swine fever
38	42		[hog cholera] virus" means a classical swine fever [hog cholera]
39	43		virus that has not been modified or inactivated.
40	44		SECTION 3. Section 165.021, Agriculture Code, is amended to
41	45		read as follows:
42	46		Sec. 165.021. COOPERATION WITH U.S. DEPARTMENT OF
43	47		AGRICULTURE. The commission may cooperate with the United States
44	48		Department of Agriculture in the eradication of vesicular
45	49		exanthema, foot and mouth disease of swine, classical swine fever
46	50		[hog cholera], and other diseases of swine.
47	51		SECTION 4. Section 165.022, Agriculture Code, is amended to
48	52		read as follows:
49	53		Sec. 165.022. METHOD OF DISEASE ERADICATION. (a) Following
50	54		notice and public hearing, the commission shall adopt rules for the
51	55		enforcement of this subchapter, including rules providing for the
52	56		manner, method, and system of eradicating swine diseases.
53	57		(b) The commission may by a two-thirds vote adopt rules
54	58		under this section that are more stringent than the [may not exceed
55	59		the rules relating to] minimum standards for cooperative programs
56	60		adopted by the Animal and Plant Health Inspection Service of the
57	61		United States Department of Agriculture.
58	62		SECTION 5. The heading to Section 165.042, Agriculture
59	63		Code, is amended to read as follows:
60	64		Sec. 165.042. SALE OF UNATTENUATED CLASSICAL SWINE FEVER
61	65		[HOG CHOLERA] VIRUS.
62	66		SECTION 6. The amendments made by this Act to replace
63	67		references to "hog cholera" with "classical swine fever" are a
64	68		clarification of existing law and do not imply that existing law may
65	69		be construed as inconsistent with the law as amended by this Act.
66	70		SECTION 7. This Act takes effect September 1, 2021.
