9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Sections 161.148(a) and (b), Agriculture Code, | |
11 | 11 | are amended to read as follows: | |
12 | 12 | (a) The commission may impose an administrative penalty on | |
13 | 13 | [against] a person who violates this subtitle or a rule or order | |
14 | 14 | adopted under this subtitle. | |
15 | 15 | (b) The penalty for a violation may be in an amount not to | |
16 | 16 | exceed $5,000 [$1,000]. Each day a violation continues or occurs is | |
17 | 17 | a separate violation for purposes of imposing a penalty. The amount | |
18 | 18 | of the penalty shall not be based on a per head basis. | |
19 | 19 | SECTION 2. The changes in law made by this Act apply only to | |
20 | 20 | a violation committed on or after the effective date of this Act. A | |
21 | 21 | violation committed before the effective date of this Act is | |
22 | 22 | governed by the law in effect when the violation was committed, and | |
23 | 23 | the former law is continued in effect for that purpose. For | |
24 | 24 | purposes of this section, a violation was committed before the | |
25 | 25 | effective date of this Act if any element of the violation occurred | |
26 | 26 | before that date. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
