| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 13, Water Code, is amended |
|---|
| 11 | 11 | | by adding Section 13.3011 to read as follows: |
|---|
| 12 | 12 | | Sec. 13.3011. INITIAL RATES FOR CERTAIN WATER OR SEWER |
|---|
| 13 | 13 | | SYSTEMS AFTER PURCHASE OR ACQUISITION. (a) A person who files an |
|---|
| 14 | 14 | | application described by Section 13.301(a) for the purchase or |
|---|
| 15 | 15 | | acquisition of a water or sewer system may request that the |
|---|
| 16 | 16 | | regulatory authority with original jurisdiction over the rates for |
|---|
| 17 | 17 | | water or sewer service provided by the person to the customers of |
|---|
| 18 | 18 | | the system authorize the person to charge initial rates for the |
|---|
| 19 | 19 | | service that are: |
|---|
| 20 | 20 | | (1) shown in a tariff filed with a regulatory |
|---|
| 21 | 21 | | authority by the person for another water or sewer system; and |
|---|
| 22 | 22 | | (2) in force for the other water or sewer system on the |
|---|
| 23 | 23 | | date the application described by Section 13.301(a) is filed. |

| 24 | 24 | | (b) The regulatory authority may not require a person who |
|---|
| 25 | 25 | | makes a request under Subsection (a) to initiate a new rate |
|---|
| 26 | 26 | | proceeding to establish the initial rates for service the person |
|---|
| 27 | 27 | | will provide to the customers of the purchased or acquired system. |
|---|
| 28 | 28 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 29 | 29 | | to a purchase or acquisition of a water or sewer system the |
|---|
| 30 | 30 | | application for which is filed under Section 13.301(a), Water Code, |
|---|
| 31 | 31 | | on or after the effective date of this Act. A purchase or |
|---|
| 32 | 32 | | acquisition of a water or sewer system the application for which is |
|---|
| 33 | 33 | | filed under Section 13.301(a), Water Code, before the effective |
|---|
| 34 | 34 | | date of this Act is governed by the law in effect on the date the |
|---|
| 35 | 35 | | application was filed, and the former law is continued in effect for |
|---|
| 36 | 36 | | that purpose. |

| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2021. |
