6	6	AN ACT
7	7	relating to the designation of centers of excellence for the
8	8	management and treatment of placenta accreta spectrum disorder.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 32, Health and Safety Code, is amended by
11	11	adding Subchapter G to read as follows:
12	12	SUBCHAPTER G. CENTERS OF EXCELLENCE FOR MANAGEMENT AND TREATMENT
13	13	OF PLACENTA ACCRETA SPECTRUM DISORDER
14	14	Sec. 32.201. DEFINITION. In this subchapter, "placenta
15	15	accreta spectrum disorder" includes placenta accreta, placenta
16	16	increta, and placenta percreta.
17	17	Sec. 32.202. DESIGNATION OF CENTERS OF EXCELLENCE. (a) The
18	18	department, in consultation with the Texas Maternal Mortality and
19	19	Morbidity Review Committee established under Chapter 34, shall
20	20	designate as centers of excellence for the management and treatment
21	21	of placenta accreta spectrum disorder one or more health care
22	22	entities or programs in this state, including any institution or
23	23	community hospital with the appropriate resources and personnel, as
24	24	determined by the department and the review committee.
25	25	(b) The executive commissioner, in consultation with the
26	26	department and the Texas Maternal Mortality and Morbidity Review
27	27	Committee, shall adopt rules necessary for a health care entity or
28	28	program in this state to be designated as a center of excellence for
29	29	management and treatment of placenta accreta spectrum disorder.
30	30	Sec. 32.203. SUBCOMMITTEE. (a) The department, in
31	31	consultation with the Texas Maternal Mortality and Morbidity Review
32	32	Committee, shall appoint a subcommittee of the review committee to
33	33	advise the executive commissioner on the adoption of rules under
34	34	Section 32.202. As part of the subcommittee's duties under this
35	35	subsection, the subcommittee specifically shall advise the
36	36	executive commissioner on the criteria necessary for a health care
37	37	entity or program in this state to be awarded a designation under
38	38	this subchapter.
39	39	(b) The subcommittee must consist of individuals with
40	40	expertise in the management and treatment of placenta accreta
41	41	spectrum disorder. A majority of the members of the subcommittee
42	42	must practice in those areas in a health profession in this state.
43	43	The subcommittee may include national and international experts.
44	44	Sec. 32.204. PRIORITY CONSIDERATIONS FOR CENTER
45	45	DESIGNATIONS. The rules adopted under Section 32.202 must
46	46	prioritize awarding a designation under this subchapter to a health
47	47	care entity or program that:
48	48	(1) offers specialized management services for
49	49	placenta accreta spectrum disorder through a multi-specialty
50	50	clinical program and an associated hospital that provides advanced
51	51	neonatal and maternal care in accordance with the hospital's level
52	52	of care designation assigned under Section 241.182;
53	53	(2) demonstrates a significant commitment to research
54	54	in and advancing the field of care for placenta accreta spectrum
55	55	disorder;
56	56	(3) fosters telemedicine, referral, and transport
57	57	relationships with rural hospitals in this state; and
58	58	(4) integrates an advanced placenta accreta spectrum
59	59	disorder management program with a program that provides
60	60	appropriate long-term monitoring and follow-up care for patients.
61	61	Sec. 32.205. REQUIREMENTS FOR CENTER DESIGNATION. The
62	62	rules adopted under Section 32.202 must ensure that a health care
63	63	entity or program in this state that receives a center of excellence
64	64	designation under this subchapter:
65	65	(1) provides or is affiliated with a hospital that
66	66	provides advanced neonatal and maternal care in accordance with the
67	67	hospital's level of care designation assigned under Section
68	68	241.182;
69	69	(2) establishes minimum criteria for medical,
70	70	nursing, ancillary, and support staff, in addition to any other
71	71	criteria required under Section 32.202;
72	72	(3) measures short-term and long-term patient
73	73	diagnostic and therapeutic outcomes; and
74	74	(4) submits to the department annual reports
75	75	containing aggregate data on short-term and long-term diagnostic
76	76	and therapeutic outcomes as requested or required by the department
77	77	and makes those reports available to the public on the entity's or
78	78	program's Internet website.
79	79	SECTION 2. (a) Not later than December 1, 2021, the
80	80	Department of State Health Services, in consultation with the Texas
81	81	Maternal Mortality and Morbidity Review Committee established
82	82	under Chapter 34, Health and Safety Code, shall appoint members to
83	83	the subcommittee as required by Section 32.203, Health and Safety
84	84	Code, as added by this Act.
85	85	(b) Not later than September 1, 2022, the executive
86	86	commissioner of the Health and Human Services Commission shall
87	87	adopt rules as required by Section 32.202, Health and Safety Code,
88	88	as added by this Act.
89	89	(c) Not later than September 1, 2022, the Department of
90	90	State Health Services shall begin awarding designations of centers
91	91	of excellence as required by Subchapter G, Chapter 32, Health and
92	92	Safety Code, as added by this Act.
93	93	SECTION 3. This Act takes effect September 1, 2021.
