66 AN ACT
77 relating to the designation of centers of excellence for the
88 management and treatment of placenta accreta spectrum disorder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 32, Health and Safety Code, is amended by
1111 adding Subchapter G to read as follows:
1212 SUBCHAPTER G. CENTERS OF EXCELLENCE FOR MANAGEMENT AND TREATMENT
1313 OF PLACENTA ACCRETA SPECTRUM DISORDER
1414 Sec. 32.201. DEFINITION. In this subchapter, "placenta
1515 accreta spectrum disorder" includes placenta accreta, placenta
1616 increta, and placenta percreta.
1717 Sec. 32.202. DESIGNATION OF CENTERS OF EXCELLENCE. (a) The
1818 department, in consultation with the Texas Maternal Mortality and
1919 Morbidity Review Committee established under Chapter 34, shall
2020 designate as centers of excellence for the management and treatment
2121 of placenta accreta spectrum disorder one or more health care
2222 entities or programs in this state, including any institution or
2323 community hospital with the appropriate resources and personnel, as
2424 determined by the department and the review committee.
2525 (b) The executive commissioner, in consultation with the
2626 department and the Texas Maternal Mortality and Morbidity Review
2727 Committee, shall adopt rules necessary for a health care entity or
2828 program in this state to be designated as a center of excellence for
2929 management and treatment of placenta accreta spectrum disorder.
3030 Sec. 32.203. SUBCOMMITTEE. (a) The department, in
3131 consultation with the Texas Maternal Mortality and Morbidity Review
3232 Committee, shall appoint a subcommittee of the review committee to
3333 advise the executive commissioner on the adoption of rules under
3434 Section 32.202. As part of the subcommittee's duties under this
3535 subsection, the subcommittee specifically shall advise the
3636 executive commissioner on the criteria necessary for a health care
3737 entity or program in this state to be awarded a designation under
3838 this subchapter.
3939 (b) The subcommittee must consist of individuals with
4040 expertise in the management and treatment of placenta accreta
4141 spectrum disorder. A majority of the members of the subcommittee
4242 must practice in those areas in a health profession in this state.
4343 The subcommittee may include national and international experts.
4444 Sec. 32.204. PRIORITY CONSIDERATIONS FOR CENTER
4545 DESIGNATIONS. The rules adopted under Section 32.202 must
4646 prioritize awarding a designation under this subchapter to a health
4747 care entity or program that:
4848 (1) offers specialized management services for
4949 placenta accreta spectrum disorder through a multi-specialty
5050 clinical program and an associated hospital that provides advanced
5151 neonatal and maternal care in accordance with the hospital's level
5252 of care designation assigned under Section 241.182;
5353 (2) demonstrates a significant commitment to research
5454 in and advancing the field of care for placenta accreta spectrum
5555 disorder;
5656 (3) fosters telemedicine, referral, and transport
5757 relationships with rural hospitals in this state; and
5858 (4) integrates an advanced placenta accreta spectrum
5959 disorder management program with a program that provides
6060 appropriate long-term monitoring and follow-up care for patients.
6161 Sec. 32.205. REQUIREMENTS FOR CENTER DESIGNATION. The
6262 rules adopted under Section 32.202 must ensure that a health care
6363 entity or program in this state that receives a center of excellence
6464 designation under this subchapter:
6565 (1) provides or is affiliated with a hospital that
6666 provides advanced neonatal and maternal care in accordance with the
6767 hospital's level of care designation assigned under Section
6868 241.182;
6969 (2) establishes minimum criteria for medical,
7070 nursing, ancillary, and support staff, in addition to any other
7171 criteria required under Section 32.202;
7272 (3) measures short-term and long-term patient
7373 diagnostic and therapeutic outcomes; and
7474 (4) submits to the department annual reports
7575 containing aggregate data on short-term and long-term diagnostic
7676 and therapeutic outcomes as requested or required by the department
7777 and makes those reports available to the public on the entity's or
7878 program's Internet website.
7979 SECTION 2. (a) Not later than December 1, 2021, the
8080 Department of State Health Services, in consultation with the Texas
8181 Maternal Mortality and Morbidity Review Committee established
8282 under Chapter 34, Health and Safety Code, shall appoint members to
8383 the subcommittee as required by Section 32.203, Health and Safety
8484 Code, as added by this Act.
8585 (b) Not later than September 1, 2022, the executive
8686 commissioner of the Health and Human Services Commission shall
8787 adopt rules as required by Section 32.202, Health and Safety Code,
8888 as added by this Act.
8989 (c) Not later than September 1, 2022, the Department of
9090 State Health Services shall begin awarding designations of centers
9191 of excellence as required by Subchapter G, Chapter 32, Health and
9292 Safety Code, as added by this Act.
9393 SECTION 3. This Act takes effect September 1, 2021.
