106 AN ACT
117 relating to the establishment of the State Advisory Council on
128 Educational Opportunity for Military Children.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 162.001, Education Code, is amended by
1511 adding Subdivision (3) to read as follows:
1612 (3) "State Advisory Council" means the State Advisory
1713 Council on Educational Opportunity for Military Children
1814 established under Section 162.006.
1915 SECTION 2. Chapter 162, Education Code, is amended by
2016 adding Section 162.006 to read as follows:
2117 Sec. 162.006. STATE ADVISORY COUNCIL AND COORDINATION. (a)
2218 The compact commissioner, in coordination with the Texas Education
2319 Agency, shall establish the State Advisory Council on Educational
2420 Opportunity for Military Children to provide for coordination among
2521 state agencies, school districts, and military installations
2622 concerning the state's participation in and compliance with the
2723 compact and compact activities, as required by Article VIII of the
2824 compact.
2925 (b) The State Advisory Council consists of:
3026 (1) the commissioner of education or the
3127 commissioner's designee;
3228 (2) a superintendent of a school district with a high
3329 concentration of military children designated by the agency;
3430 (3) the governor or the governor's designee;
3531 (4) the chair of the senate committee on education or a
3632 member of the senate committee on education designated by the
3733 agency;
3834 (5) the chair of the house of representatives
3935 committee on public education or a member of the house of
4036 representatives committee on public education designated by the
4137 agency;
4238 (6) a representative from each branch of the armed
4339 services of the United States that maintains an installation in the
4440 state, designated by the agency; and
4541 (7) representatives of other offices and stakeholder
4642 groups the agency deems appropriate.
4743 (c) Members of the State Advisory Council may delegate
4844 voting authority to another person for a specified meeting or
4945 meetings.
5046 (d) Meetings of the State Advisory Council may be conducted
5147 face-to-face or by telephone or other means of telecommunication or
5248 electronic communication.
5349 (e) The State Advisory Council shall:
5450 (1) meet at least quarterly; and
5551 (2) provide State Advisory Council meeting dates,
5652 agendas, minutes, end-of-year reports, and other documentation as
5753 required to the Military Interstate Children's Compact Commission.
5854 (f) The State Advisory Council shall perform each function
5955 or duty required or authorized under Article VIII of the compact.
6056 (g) The State Advisory Council shall establish policies and
6157 procedures governing the State Advisory Council's operations.
6258 (h) The State Advisory Council is a governmental body for
6359 purposes of Chapter 551, Government Code.
6460 SECTION 3. Section 162.005, Education Code, is repealed.
6561 SECTION 4. This Act takes effect September 1, 2021.
