| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 533.0063(b), Government Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (b) A [Except as provided by Subsection (c), a] managed care | |
| 13 | 13 | organization is required to send a paper form of the organization's | |
| 14 | 14 | provider network directory for the program only to a recipient who | |
| 15 | 15 | requests to receive the directory in paper form. | |
| 16 | 16 | SECTION 2. Section 533.0063(c), Government Code, is | |
| 17 | 17 | repealed. | |
| 18 | 18 | SECTION 3. If before implementing any provision of this Act | |
| 19 | 19 | a state agency determines that a waiver or authorization from a | |
| 20 | 20 | federal agency is necessary for implementation of that provision, | |
| 21 | 21 | the agency affected by the provision shall request the waiver or | |
| 22 | 22 | authorization and may delay implementing that provision until the | |
| 23 | 23 | waiver or authorization is granted. | |
| 24 | 24 | SECTION 4. This Act takes effect immediately if it receives | |
| 25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
| 26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
| 27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
| 28 | 28 | Act takes effect September 1, 2021. |
