55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a matching grant program for school districts for the
88 development and implementation of programs to address the social,
99 emotional, and behavioral needs of students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter G, Chapter 38, Education Code, is
1212 amended by adding Section 38.354 to read as follows:
1313 Sec. 38.354. MATCHING GRANT PROGRAM. (a) Subject to the
1414 availability of federal or state-appropriated funds, the
1515 commissioner shall establish a program under which grants are
1616 awarded to school districts in an amount to match the amount of
1717 funds pledged by the district to develop and implement programs
1818 addressing the social, emotional, and behavioral needs of students.
1919 Funds used by a district to establish a program under this section
2020 must be funds received by the district through the school safety
2121 allotment as provided by Section 48.115.
2222 (b) In awarding grants under this section, the commissioner
2323 shall prioritize the award of grants to school districts located in
2424 rural areas and areas that have low property wealth per student.
2525 (c) A program developed by a school district using a grant
2626 awarded under this section must include research-based practices
2727 and may include training, technical assistance, mentoring,
2828 coaching, and evaluation services for district personnel and
2929 program participants.
3030 (d) The commissioner shall adopt rules necessary to
3131 establish the matching grant program under this section.
3232 SECTION 2. Section 42.168, Education Code, as added by
3333 Chapter 464 (S.B. 11), Acts of the 86th Legislature, Regular
3434 Session, 2019, is transferred to Subchapter C, Chapter 48,
3535 Education Code, redesignated as Section 48.115, Education Code, and
3636 amended to conform to changes made by Chapter 943 (H.B. 3), Acts of
3737 the 86th Legislature, Regular Session, 2019, to read as follows:
3838 Sec. 48.115 [42.168]. SCHOOL SAFETY ALLOTMENT. (a) In
3939 this section, "postvention" has the meaning assigned by Section
4040 38.351.
4141 (b) From funds appropriated for that purpose, the
4242 commissioner shall provide to a school district an annual allotment
4343 in the amount provided by appropriation for each student in average
4444 daily attendance.
4545 (c) [(b)] Funds allocated under this section must be used to
4646 improve school safety and security, including costs associated
4747 with:
4848 (1) securing school facilities, including:
4949 (A) improvements to school infrastructure;
5050 (B) the use or installation of physical barriers;
5151 and
5252 (C) the purchase and maintenance of:
5353 (i) security cameras or other security
5454 equipment; and
5555 (ii) technology, including communications
5656 systems or devices, that facilitates communication and information
5757 sharing between students, school personnel, and first responders in
5858 an emergency;
5959 (2) providing security for the district, including:
6060 (A) employing school district peace officers,
6161 private security officers, and school marshals; and
6262 (B) collaborating with local law enforcement
6363 agencies, such as entering into a memorandum of understanding for
6464 the assignment of school resource officers to schools in the
6565 district;
6666 (3) school safety and security training and planning,
6767 including:
6868 (A) active shooter and emergency response
6969 training;
7070 (B) prevention and treatment programs relating
7171 to addressing adverse childhood experiences; and
7272 (C) the prevention, identification, and
7373 management of emergencies and threats, including:
7474 (i) providing mental health personnel and
7575 support;
7676 (ii) providing behavioral health services;
7777 and
7878 (iii) establishing threat reporting
7979 systems; and
8080 (4) providing programs related to the social,
8181 emotional, and behavioral needs of students, including programs
8282 related to suicide prevention, intervention, and postvention.
8383 (d) [(c)] A school district may use funds allocated under
8484 this section for equipment or software that is used for a school
8585 safety and security purpose and an instructional purpose, provided
8686 that the instructional use does not compromise the safety and
8787 security purpose of the equipment or software.
8888 (e) [(d)] A school district that is required to take action
8989 under Chapter 49 [41] to reduce its local revenue level [wealth per
9090 student] to the [equalized wealth] level established under Section
9191 48.257 is entitled to a credit, in the amount of the allotments to
9292 which the district is to receive as provided by appropriation,
9393 against the total amount required under Section 49.153 [41.093] for
9494 the district to purchase attendance credit [credits].
9595 (f) [(e)] The commissioner may adopt rules to implement
9696 this section.
9797 SECTION 3. To the extent of any conflict, this Act prevails
9898 over another Act of the 87th Legislature, Regular Session, 2021,
9999 relating to nonsubstantive additions to and corrections in enacted
100100 codes.
101101 SECTION 4. This Act takes effect September 1, 2021.
