7 | 7 | | relating to a matching grant program for school districts for the |
---|
8 | 8 | | development and implementation of programs to address the social, |
---|
9 | 9 | | emotional, and behavioral needs of students. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
11 | 11 | | SECTION 1. Subchapter G, Chapter 38, Education Code, is |
---|
12 | 12 | | amended by adding Section 38.354 to read as follows: |
---|
13 | 13 | | Sec. 38.354. MATCHING GRANT PROGRAM. (a) Subject to the |
---|
14 | 14 | | availability of federal or state-appropriated funds, the |
---|
15 | 15 | | commissioner shall establish a program under which grants are |
---|
16 | 16 | | awarded to school districts in an amount to match the amount of |
---|
17 | 17 | | funds pledged by the district to develop and implement programs |
---|
18 | 18 | | addressing the social, emotional, and behavioral needs of students. |
---|
19 | 19 | | Funds used by a district to establish a program under this section |
---|
20 | 20 | | must be funds received by the district through the school safety |
---|
21 | 21 | | allotment as provided by Section 48.115. |
---|
22 | 22 | | (b) In awarding grants under this section, the commissioner |
---|
23 | 23 | | shall prioritize the award of grants to school districts located in |
---|
24 | 24 | | rural areas and areas that have low property wealth per student. |
---|
25 | 25 | | (c) A program developed by a school district using a grant |
---|
26 | 26 | | awarded under this section must include research-based practices |
---|
27 | 27 | | and may include training, technical assistance, mentoring, |
---|
28 | 28 | | coaching, and evaluation services for district personnel and |
---|
29 | 29 | | program participants. |
---|
30 | 30 | | (d) The commissioner shall adopt rules necessary to |
---|
31 | 31 | | establish the matching grant program under this section. |
---|
32 | 32 | | SECTION 2. Section 42.168, Education Code, as added by |
---|
33 | 33 | | Chapter 464 (S.B. 11), Acts of the 86th Legislature, Regular |
---|
34 | 34 | | Session, 2019, is transferred to Subchapter C, Chapter 48, |
---|
35 | 35 | | Education Code, redesignated as Section 48.115, Education Code, and |
---|
36 | 36 | | amended to conform to changes made by Chapter 943 (H.B. 3), Acts of |
---|
37 | 37 | | the 86th Legislature, Regular Session, 2019, to read as follows: |
---|
38 | 38 | | Sec. 48.115 [42.168]. SCHOOL SAFETY ALLOTMENT. (a) In |
---|
39 | 39 | | this section, "postvention" has the meaning assigned by Section |
---|
40 | 40 | | 38.351. |
---|
41 | 41 | | (b) From funds appropriated for that purpose, the |
---|
42 | 42 | | commissioner shall provide to a school district an annual allotment |
---|
43 | 43 | | in the amount provided by appropriation for each student in average |
---|
44 | 44 | | daily attendance. |
---|
45 | 45 | | (c) [(b)] Funds allocated under this section must be used to |
---|
46 | 46 | | improve school safety and security, including costs associated |
---|
47 | 47 | | with: |
---|
48 | 48 | | (1) securing school facilities, including: |
---|
49 | 49 | | (A) improvements to school infrastructure; |
---|
50 | 50 | | (B) the use or installation of physical barriers; |
---|
51 | 51 | | and |
---|
52 | 52 | | (C) the purchase and maintenance of: |
---|
53 | 53 | | (i) security cameras or other security |
---|
54 | 54 | | equipment; and |
---|
55 | 55 | | (ii) technology, including communications |
---|
56 | 56 | | systems or devices, that facilitates communication and information |
---|
57 | 57 | | sharing between students, school personnel, and first responders in |
---|
58 | 58 | | an emergency; |
---|
59 | 59 | | (2) providing security for the district, including: |
---|
60 | 60 | | (A) employing school district peace officers, |
---|
61 | 61 | | private security officers, and school marshals; and |
---|
62 | 62 | | (B) collaborating with local law enforcement |
---|
63 | 63 | | agencies, such as entering into a memorandum of understanding for |
---|
64 | 64 | | the assignment of school resource officers to schools in the |
---|
65 | 65 | | district; |
---|
66 | 66 | | (3) school safety and security training and planning, |
---|
67 | 67 | | including: |
---|
68 | 68 | | (A) active shooter and emergency response |
---|
69 | 69 | | training; |
---|
70 | 70 | | (B) prevention and treatment programs relating |
---|
71 | 71 | | to addressing adverse childhood experiences; and |
---|
72 | 72 | | (C) the prevention, identification, and |
---|
73 | 73 | | management of emergencies and threats, including: |
---|
74 | 74 | | (i) providing mental health personnel and |
---|
75 | 75 | | support; |
---|
76 | 76 | | (ii) providing behavioral health services; |
---|
77 | 77 | | and |
---|
78 | 78 | | (iii) establishing threat reporting |
---|
79 | 79 | | systems; and |
---|
80 | 80 | | (4) providing programs related to the social, |
---|
81 | 81 | | emotional, and behavioral needs of students, including programs |
---|
82 | 82 | | related to suicide prevention, intervention, and postvention. |
---|
83 | 83 | | (d) [(c)] A school district may use funds allocated under |
---|
84 | 84 | | this section for equipment or software that is used for a school |
---|
85 | 85 | | safety and security purpose and an instructional purpose, provided |
---|
86 | 86 | | that the instructional use does not compromise the safety and |
---|
87 | 87 | | security purpose of the equipment or software. |
---|
88 | 88 | | (e) [(d)] A school district that is required to take action |
---|
89 | 89 | | under Chapter 49 [41] to reduce its local revenue level [wealth per |
---|
90 | 90 | | student] to the [equalized wealth] level established under Section |
---|
91 | 91 | | 48.257 is entitled to a credit, in the amount of the allotments to |
---|
92 | 92 | | which the district is to receive as provided by appropriation, |
---|
93 | 93 | | against the total amount required under Section 49.153 [41.093] for |
---|
94 | 94 | | the district to purchase attendance credit [credits]. |
---|
95 | 95 | | (f) [(e)] The commissioner may adopt rules to implement |
---|
96 | 96 | | this section. |
---|
97 | 97 | | SECTION 3. To the extent of any conflict, this Act prevails |
---|
98 | 98 | | over another Act of the 87th Legislature, Regular Session, 2021, |
---|
99 | 99 | | relating to nonsubstantive additions to and corrections in enacted |
---|
100 | 100 | | codes. |
---|
101 | 101 | | SECTION 4. This Act takes effect September 1, 2021. |
